DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 7843:
1. Accept the conciliation agreement with Marathon Petroleum Company LP, as
recommended in the Memorandum to the Commission dated January 26, 2022.
2. Dismiss the allegation that the Senate Leadership Fund and Caleb Crosby in his
official capacity as treasurer violated 52 U.S.C. § 30119(a)(2) by soliciting a federal contractor contribution.
3. Dismiss the allegation that the Congressional Leadership Fund and Caleb Crosby in his official capacity as treasurer violated 52 U.S.C. § 30119(a)(2) by soliciting a federal contractor contribution.
4. Approve the appropriate letters.
5. Close the file.
The Commission failed by a vote of 3-3 to:
a. Find reason to believe that Marathon Petroleum Company LP violated 52 U.S.C.
§ 30119(a)(1) by making a federal government contractor contribution.
b. Take no action at this time as to Senate Leadership Fund and Caleb Crosby in his official capacity as treasurer.
c. Take no action at this time as to Congressional Leadership Fund and Caleb Crosby in his official capacity as treasurer.
d. Authorize pre-probable cause conciliation with Marathon Petroleum Company LP.
e. Approve the Factual and Legal Analysis for Marathon Petroleum Company LP, as recommended in the First General Counsel’s Report dated August 18, 2021, subject to the edits last circulated by Commissioner Cooksey’s Office on October 13, 2021 at 2:26 p.m.
f. Approve the proposed Conciliation Agreement, as drafted by the Office of General Counsel.
g. Send the appropriate letters.
