DISPOSITION: The Commission failed by vote of 3-3 to:
a. Find reason to believe that Friends of Byron Donalds and Noreen A. Fenner as treasurer violated 52 U.S.C. § 30125(e) by soliciting, receiving, directing, transferring, or spending non-federal funds.
b. Find reason to believe that Byron Donalds violated 52 U.S.C. § 30125(e) by soliciting, receiving, directing, transferring, or spending non-federal funds.
c. Take no action at this time as to the allegation that Conservatives for Effective Governments and David Ramba as treasurer violated 52 U.S.C. § 30125(e) by soliciting, receiving, directing, transferring, or spending non-federal funds.
d. Take no action at this time as to the allegation that Byron Donalds for Congress and Bradley T. Crate in his official capacity as treasurer violated 52 U.S.C. § 30125(e) by soliciting, receiving, directing, transferring, or spending non-federal funds.
e. Take no action at this time as to the allegation that Friends of Byron Donalds and Noreen A. Fenner as treasurer violated 52 U.S.C. § 30122 by making contributions in the name of another.
f. Take no action at this time as to the allegation that Conservatives for Effective Government and David Ramba as treasurer violated 52 U.S.C. § 30122 by making contributions in the name of another.
g. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated April 8, 2021.
h. Authorize the use of compulsory process.
i. Approve the appropriate letters.
The Commission failed by a vote of 3-3 to:
a. Find no reason to believe that Friends of Byron Donalds and Noreen A. Fenner as treasurer violated 52 U.S.C. § 30125(e) by soliciting, receiving, directing, transferring, or spending non-federal funds.
b. Find no reason to believe that Byron Donalds violated 52 U.S.C. § 30125(e) by soliciting, receiving, directing, transferring, or spending non-federal funds.
c. Find no reason to believe that Conservatives for Effective Government and David Ramba as treasurer violated 52 U.S.C. § 30125(e) by soliciting, receiving, directing, transferring, or spending non-federal funds.
d. Find no reason to believe that Byron Donalds for Congress and Bradley T. Crate in his official capacity as treasurer violated 52 U.S.C. § 30125(e) by soliciting, receiving, directing, transferring, or spending non-federal funds.
e. Find no reason to believe that Friends of Byron Donalds and Noreen A. Fenner as treasurer violated 52 U.S.C. § 30122 by making contributions in the name of another.
f. Find no reason to believe that Conservatives for Effective Government and David Ramba as treasurer violated 52 U.S.C. § 30122 by making contributions in the name of another.
g. Close the file.
h. Issue appropriate letters.
