DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MUR
7727:
1. Reopen MUR 7727.
2. Find no reason to believe that Sara Gideon violated 52 U.S.C. § 30116(f) and 11 C.F.R.
§ 110.9 by knowingly accepting an excessive contribution.
3. Rescind the Factual and Legal Analysis approved on March 8, 2022.
4. Approve the Factual and Legal Analysis, as recommended in the Memorandum to the Commission dated March 24, 2022.
5. Approve the appropriate letters.
6. Close the file.
The Commission failed by a vote of 2-4 to:
a. Dismiss the allegation that Majority Forward violated 52 U.S.C. § 30116(a) and 11 C.F.R.
§ 110.2(b) by making an excessive contribution.
b. Dismiss the allegation that Sara Gideon for Maine and Lisa Lunn in her official capacity as treasurer violated 52 U.S.C. § 30116(f) and 11 C.F.R. § 110.9 by knowingly accepting an excessive contribution.
c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated October 19, 2020, subject to the edits circulated by the Republican Commissioner’s Offices on March 1, 2022 at 3:36 p.m., and subject to the further edit to add the words “under Commission’s regulations” at the beginning of the sentence on page 5 line 11, and reject the change from dismissal to no reason to believe and revert back to dismissal in the Factual and Legal Analysis.
d. Close the file.
e. Approve the appropriate letters.
The Commission decided by a vote of 4-1 to:
a. Find no reason to believe that Majority Forward violated 52 U.S.C. § 30116(a) and
11 C.F.R. § 110.2(b) by making an excessive contribution.
b. Find no reason to believe that Sara Gideon for Maine and Lisa Lunn in her official capacity as treasurer violated 52 U.S.C. § 30116(f) and 11 C.F.R. § 110.9 by knowingly accepting an excessive contribution.
c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated October 19, 2020, subject to the edits last circulated by Chairman Dickerson’s Office on March 1, 2022 at 3:36 p.m.
d. Close the file.
e. Approve the appropriate letters.
