DISPOSITION: The Commission failed by a vote of 3-3 to:
1. Dismiss the allegation that the Republican National Committee and Ronald C. Kaufman in his official capacity as treasurer violated 52 U.S.C. § 30120(a) and 11 C.F.R. § 110.11(a) by failing to include a proper disclaimer on a public communication, and send a letter of caution.
2. Find no reason to believe that Ronna McDaniel violated 52 U.S.C. § 30120(a) and 11 C.F.R. § 110.11(a) by failing to include a proper disclaimer on a public communication.
3. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated August 4, 2020, subject to the edits to the Factual and Legal Analysis as last circulated by Commissioner Weintraub’s Office on July 29, 2021 at 11:31 a.m.
4. Approve the appropriate letters.
5. Close the file.
