DISPOSITION: The Commission failed by a vote of 2-3 to:
a. Dismiss the allegation that Troy Nehls violated 52 U.S.C. § 30102(e) and 11 C.F.R. § 101.1(a) by failing to timely file his Statement of Candidacy.
b. Dismiss the allegation that Troy Nehls violated 11 C.F.R. §§ 100.72(a), 100.131(a) by using impermissible funds to test the waters of a federal election.
c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated April 3, 2020, subject to such conforming edits as suggested by the Office of General Counsel at the table.
d. Approve the appropriate letter.
e. Close the file.
