SUBJECT: Committees-Presidential; Committees-PAC; Contributions-Excessive; Reporting
DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MURs 7631 and 7634:
1. Accept the conciliation agreement, as recommended in the Memorandum to the Commission dated March 20, 2023.
2. Take no further action as to Bill de Blasio.
3. Approve the appropriate letters.
4. Close the file.
The Commission decided by a vote of 6-0 to approve the Proposed Factual and Legal Analyses and Conciliation Agreements, as recommended in the Memorandum to the Commission dated September 27, 2022, subject to the Office of General Counsel’s Notice of Errata dated October 13, 2022, and also subject to replacing the phrase “should find” with “finds” in heading III.A on page 12 of the proposed Factual and Legal Analysis for De Blasio 2020.
The Commission failed by a vote of 2-3 to:
a. Find reason to believe that Bill de Blasio and NY Fairness PAC violated 52 U.S.C.
§ 30125(e) and (f).
b. Direct the Office of General Counsel to include this finding in the Factual and Legal Analysis for NY Fairness PAC.
The Commission failed by vote of 2-2 to:
a. Find reason to believe that Fairness PAC and Herbert Block in his official capacity as treasurer violated 52 U.S.C. § 30104(a) and (b) and 11 C.F.R. §§ 100.72(a) and 100.131(a) by failing to report in-kind contributions.
b. Amend the Factual and Legal Analysis to include this finding.
The Commission failed by a vote of 2-3 to:
a. Find reason to believe that Fairness PAC and Herbert Block in his official capacity as treasurer and NY Fairness PAC violated 52 U.S.C. § 30116(a) by making excessive contributions to De Blasio 2020 and Bill de Blasio.
b. Find reason to believe that De Blasio 2020 and Herbert Block in his official capacity as treasurer and Bill de Blasio violated 52 U.S.C. § 30116(f) by accepting excessive contributions from NY Fairness PAC and Fairness PAC.
c. Find reason to believe that De Blasio 2020 and Herbert Block in his official capacity as treasurer violated 52 U.S.C. § 30104(a) and (b) and 11 C.F.R. §§ 100.72(a) and 100.131(a) by failing to report in-kind contributions and expenditures.
d. Take no action at this time as to the allegation that De Blasio 2020 and Herbert Block in his official capacity as treasurer accepted excessive contributions in violation of 52 U.S.C. § 30116(f) by accepting contributions from 25 individuals who donated to De Blasio 2020, Fairness PAC, and NY Fairness PAC.
e. Authorize conciliation with De Blasio 2020 and Herbert Block in his official capacity as treasurer, NY Fairness PAC, Fairness PAC and Herbert Block in his official capacity as treasurer, and Bill de Blasio.
f. Direct the Office of General Counsel to draft the appropriate Conciliation Agreements.
g. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated April 20, 2022.
h. Approve the appropriate letters.
The Commission decided by a vote of 6-0:
a. Find reason to believe that Fairness PAC and Herbert Block in his official capacity as treasurer violated 52 U.S.C. § 30116(a) by making excessive contributions to De Blasio 2020 and Bill de Blasio with respect to $123,000 in polling expenses.
b. Find reason to believe that NY Fairness PAC violated 52 U.S.C. § 30116(a) by making excessive contributions to De Blasio 2020 and Bill de Blasio with respect to $53,000 in expenditures for travel and consulting services.
c. Find reason to believe that De Blasio 2020 and Herbert Block in his official capacity as treasurer and Bill de Blasio violated 52 U.S.C. § 30116(f) by accepting excessive contributions from NY Fairness PAC and Fairness PAC.
d. Find reason to believe that De Blasio 2020 and Herbert Block in his official capacity as treasurer violated 52 U.S.C. § 30104(a) and (b) and 11 C.F.R. §§ 100.72(a) and 100.131(a) by failing to report $176,000 in-kind contributions and expenditures.
e. Take no action at this time as to the allegation that De Blasio 2020 and Herbert Block in his official capacity as treasurer accepted excessive contributions in violation of 52 U.S.C. § 30116(f) by accepting contributions from individuals who donated to De Blasio 2020, Fairness PAC, and NY Fairness PAC.
f. Authorize Pre-Probable Cause Conciliation.
g. Direct the Office of General Counsel to draft an appropriate Factual and Legal Analyses and Conciliation Agreement, and to submit both for Commission approval.
h. Approve the appropriate letters.
