DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 7629:
1. Accept the signed conciliation agreement, as recommended in the Memorandum to the Commission dated April 3, 2023.
2. Approve the appropriate letters.
3. Close the file.
The Commission decided by a vote of 6-0 to:
a. Open a Matter Under Review in connection with Pre-MUR 619 and merge it into MUR 7629.
b. Dismiss with admonishment that Cary Carreno violated 52 U.S.C. § 30116(a) by making excessive contributions.
c. Dismiss with admonishment that Karen L. Hunt violated 52 U.S.C. § 30116(a) by making excessive contributions.
d. Find reason to believe that Vincent Ross Spano violated 52 U.S.C. § 30116(f) by accepting excessive contributions.
e. Find reason to believe that Ross Spano for Congress and Robert Phillips, III in his official capacity as treasurer violated 52 U.S.C. §§ 30116(f) and 30104(b)(3) by accepting excessive contributions and misreporting loans.
f. Find reason to believe that Ross Spano for Congress and Robert Phillips, III violated 11 C.F.R. § 103.3(b)(3) by failing to make timely refunds of excessive contributions.
g. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated October 29, 2019, and authorize any conforming edits.
h. Enter into conciliation with Vincent Ross Spano, Ross Spano for Congress and Robert Phillips, III in his official capacity as treasurer, prior to a finding of probable cause to believe.
i. Approve the conciliation agreements, as recommended in the First General Counsel’s Report dated October 29, 2019, and authorize any conforming edits.
j. Approve the appropriate letters.
The Commission failed by a vote of 1-5 to:
a. Open a Matter Under Review in connection with Pre-MUR 619 and merge it into MUR 7629.
b. Find reason to believe that Cary Carreno violated 52 U.S.C. § 30116(a) by making excessive contributions.
c. Find reason to believe that Karen L. Hunt violated 52 U.S.C. § 30116(a) by making excessive contributions.
d. Find reason to believe that Vincent Ross Spano violated 52 U.S.C. § 30116(f) by accepting excessive contributions.
e. Find reason to believe that Ross Spano for Congress and Robert Phillips, III in his official capacity as treasurer violated 52 U.S.C. §§ 30116(f) and 30104(b)(3) by accepting excessive contributions and misreporting loans.
