1. Reject Respondents’ Redlined Conciliation Agreement dated August 26, 2021, as recommended in the Memorandum to the Commission dated September 9, 2021.

The Commission decided by a vote of 4-1 to take the following action in MUR 7587:
Approve the Factual and Legal Analysis for Senator Bernard Sanders, Bernie 2016 and Susan Jackson in her official capacity as treasurer, and Bernie 2020 and Lora Haggard in her official capacity as treasurer, as recommended in the Memorandum to the Commission dated April 13, 2021.
The Commission decided by a vote of 4-1 to:
a. Find reason to believe that Senator Bernard Sanders, Bernie 2016 and Susan Jackson in her official capacity as treasurer, and Bernie 2020 and Lora Haggard in her official capacity as treasurer violated 52 U.S.C. § 30121 and 11 C.F.R. § 110.20(g) and (i).
b. Enter into pre-probable cause conciliation with Senator Bernard Sanders, Bernie 2016 and Susan Jackson in her official capacity as treasurer, and Bernie 2020 and Lora Haggard in her official capacity as treasurer.
c. Approve the conciliation agreement, as recommended in the First General Counsel’s Report dated November 1, 2019, subject to changing the opening settlement offer to $62,000.
d. Approve the Factual and Legal Analyses circulated by Vice Chair Dickerson’s Office on March 8, 2021 at 2:38 p.m. in this matter.
e. Direct the Office of General Counsel to revise the Factual and Legal Analyses to reflect the Commission’s approval of the Office of General Counsel’s recommendation #1 in MUR 7712 (Bernie 2020, et al.).
f. Send the appropriate letters.

a. Find reason to believe that Senator Bernard Sanders, Bernie 2016 and Susan Jackson in her official capacity as treasurer, and Bernie 2020 and Lora Haggard in her official capacity as treasurer violated 52 U.S.C. § 30121 and 11 C.F.R. § 110.20(g) and (i).
b. Enter into pre-probable cause conciliation with Senator Bernard Sanders, Bernie 2016 and Susan Jackson in her official capacity as treasurer, and Bernie 2020 and Lara Haggard in her official capacity as treasurer.
c. Approve the conciliation agreement, as recommended in the First General Counsel’s Report dated November 1, 2019, subject to changing the opening settlement offer to $62,000.

The Commission failed by a vote of 2-2 to:
a. Find reason to believe that Senator Bernard Sanders, Bernie 2016 and Susan Jackson in her official capacity as treasurer, and Bernie 2020 and Lora Haggard in her official capacity as treasurer violate 52 U.S.C. § 30121 and 11 C.F.R. § 110.20(g) and (i).
b. Dismiss the allegation that Erika Andiola, Cesar Vargas, and Maria Belén Sisa violated 52 U.S.C. § 30121 by making a prohibited foreign national contribution by working for the Sanders campaign.
c. Dismiss the allegation that Maria Belén Sisa and Bernie 2016 and Susan Jackson in her official capacity as treasurer violated 52 U.S.C.§ 30121 by making and accepting $35 in foreign national contributions.
d. Enter pre-probable cause conciliation with Senator Bernard Sanders, Bernie 2016 and Susan Jackson in her official capacity as treasurer, and Bernie 2020 and Lora Haggard in her official capacity as treasurer.
