DISPOSITION: The Commission failed by a vote of 2-4 to take the following actions in MUR 7579:
1. Find reason to believe that Rashida Tlaib for Congress and Soh Suzuki in her official capacity as treasurer violated 52 U.S.C. § 30114(b) and 11 C.F.R. § 113.1(g)(1)(i)(I) by converting campaign funds to personal use in connection with salary payments to the candidate.
2. Find reason to believe that Rashida Tlaib violated 52 U.S.C. § 30114(b) and 11 C.F.R. § 113.1(g)(1)(i)(I) by coverting campaign funds to personal use in connection with salary payments to the candidate.
3. Enter into conciliation with Rashida Tlaib for Congress and Soh Suzuki in her official capacity as treasurer and Rashida Tlaib prior to a finding of probable cause to believe.
4. Approve the Factual and Legal Analysis, as recommended in the Memorandum to the Commission dated March 30, 2021, subject to clarifying the amount of salary paid.
5. Approve the attached proposed Conciliation Agreement, as recommended in the Memorandum to the Commission dated March 30, 2021.
6. Approve the appropriate letter.
The Commission decided by a vote of 5-1 to take the following actions in MUR 7579:
1. Dismiss the allegations pursuant to Heckler v. Chaney.
2. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated April 1, 2020, subject to the edits last circulated by Chair Broussard’s Office on November 29, 2021 at 2:17 p.m., with the additional revision to the total amount of salary payments on page 2 as reflected in the Office of General Counsel’s email on November 29, 2021 at 4:41 p.m., and such technical and conforming edits that may be required.
3. Approve the appropriate letters.
4. Close the file.
