DISPOSITION: The Commission failed by a vote of 3-3 to:
a. Find reason to believe that Melba Cavasso and Mikio Izuka violated 52 U.S.C. § 30116 by making excessive contributions.
b. Find reason to believe that Cavasso 4 Congress, and Sandra Lee Ahn in her official capacity as treasurer, violated 52 U.S.C. §§ 30116(f), 30125(e), and 30104(b) by receiving and failing to properly report excessive contributions.
c. Find reason to believe that Hawaii Republican Party, and Mary Smart, in her official capacity as treasurer, violated 52 U.S.C. § 30104(b) by failing to properly report earmarked contributions.
d. Take no action at this time concerning the allegations that Hawaii Republican Party, and Mary Smart, in her official capacity as treasurer, violated 11 C.F.R. § 102.9 by failing to maintain records relating to this matter.
e. Direct the Office of General Counsel to draft Factual and Legal Analyses that reflect these findings.
f. Authorize the Office of General Counsel to enter into Pre-Probable Cause Conciliation with Melba Cavasso, Mikio Inzuka, Cavasso 4 Congress, and Sandra Lee Ahn, in her official capacity as treasurer, and Hawaii Republican Party, and Mary Smart, in her official capacity as treasurer.
g. Direct the Office of General Counsel to draft Conciliation Agreements with Melba Cavasso, Mikio Inzuka, Cavasso 4 Congress and Sandra Lee Ahn, in her official capacity as treasurer, and Hawaii Republican Party, and Mary Smart, in her official capacity as treasurer.
h. Approve the appropriate letters.
The Commission failed by a vote of 2-4 to:
Take no action at this time as to the allegations that respondents Shirlene Ostrov, Miriam Hellreich, Celyn Chong Kee, Greg Lussier, David Ross, Steve Yoder, Gary Grimmer, Andersen Blom, Pam Smith, Gene Ward, Bob McDermott, Jane Tatibouet, and Gwen Honjo violated the Act in this matter.
The Commission decided by a vote of 4-2 to:
Dismiss the allegations that respondents Shirlene Ostrov, MiriamHellreich, Celyn Chong Kee, Greg Lussier, David Ross, Steve Yoder, Gary Grimmer, Andersen Blom, Pam Smith, Gene Ward, Bob McDermott, Jane Tatibouet, and Gwen Honjo violated the Act in this matter.
The Commission failed by a vote of 3-3 to:
a. Dismiss the allegations that Melba Cavasso and Mikio Izuka violated 52 U.S.C. § 30116 by making excessive contributions.
