DISPOSITION: The Commission decided by a vote of 5-1 to take the following actions in MUR 7523:
1. Approve the Factual and Legal Analysis, as circulated by the Vice Chair Dickerson’s Office on August 19, 2021 at 6:00pm.
2. Close the file.
3. Send the appropriate letters.
The Commission decided by a vote of 4-1 to take the following actions in MUR 7523:
1. The Commission reopen the file.
2. Direct the Office of General Counsel to notify the complainant and respondents that the Commission has reopened the files for further consideration.
The Commission failed by a vote of 2-4 to:
a. Dismiss the allegation, subject to Heckler v. Chaney, that Sandfire Resources America, Inc. and Sandfire Resources, NL violated 52 U.S.C. § 30121 (a)(1) by making prohibited foreign national donations.
b. Dismiss the allegation, subject to Heckler v. Chaney, that Montana Mining Association and Stop I-186 to Protect Mining and Jobs violated 52 U.S.C. § 30121(a)(2) and 11 C.F.R. § 110.20(g) by knowingly soliciting, accepting, or receiving prohibited foreign national donations.
c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated November 12, 2020.
d. Approve the appropriate letters.
e. Close the file.
The Commission decided by a vote of 4-2 to:
a. Dismiss the allegation that Sandfire Resources America, Inc. and Sandfire Resources, NL violated 52 U.S.C. § 30121(a)(1) by making prohibited foreign national donations.
b. Dismiss the allegation that Montana Mining Association and Stop I-186 to Protect Mining and Jobs violated 52 U.S.C. § 30121(a)(2)and 11 C.F.R. § 110.20(g) by knowingly soliciting, accepting, or receiving prohibited foreign national donations.
c. Approve the appropriate letters.
d. Close the file.
