DISPOSITION: The Commission decided by a vote of 5-1 to take the following actions in MUR 7437:
1. Accept the conciliation agreement with Randy Bryce and Randy Bryce for Congress and John Tate, III, in his official capacity as treasurer, as recommended in the Memorandum to the Commission dated on November 30, 2022.
2. Approve the appropriate letter.
3. Close the file.
The Commission decided by a vote of 5-1 to take the following actions in MUR 7437:
1. Approve the revised Factual and Legal Analysis, as recommended in the Memorandum to the Commission dated June 11, 2021.
2. Approve the revised proposed Conciliation Agreement, as recommended in the Memorandum to the Commission dated June 11, 2021.
The Commission failed by a vote of 3-3 to take the following actions in MUR 7437:
1. Dismiss the allegation pursuant to Heckler v. Chaney that Randy Bryce and Randy Bryce for Congress and John Tate, III, in his official capacity as treasurer violated 52 U.S.C. § 30116(f) by accepting an excessive contribution from David Keith.
2. Dismiss the allegation pursuant to Heckler v. Chaney that Randy Bryce for Congress and John Tate, III, in his official capacity as treasurer violated 52 U.S.C. § 30104(b) by failing to report the excessive contribution.
3. Close the file.
4. Send the appropriate letters.
The Commission failed by a vote of 3-3 to:
a. Find reason to believe that Randy Bryce and Randy Bryce for Congress and John Tate, III, in his official capacity as treasurer violated 52 U.S.C. § 30114(b)(1).
b. Find reason to believe that Randy Bryce and Randy Bryce for Congress and John Tate, III, in his official capacity as treasurer violated 52 U.S.C. § 30116(f).
c. Find reason to believe that Randy Bryce for Congress and John Tate, III, in his official capacity as treasurer violated 52 U.S.C. § 30104(b)(3).
d. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated February 13, 2019.
e. Authorize pre-probable cause conciliation with Randy Bryce and Randy Bryce for Congress and John Tate, III, in his official capacity as treasurer.
f. Approve the proposed conciliation agreement, as recommended in the First General Counsel’s Report dated February 13, 2019.
g. Approve the appropriate letters.
The Commission decided by a vote of 5-1 to:
a. Find reason to believe that Randy Bryce and Randy Bryce for Congress and John Tate, III, in his official capacity as treasurer violated 52 U.S.C. § 30114(b)(1) by converting campaign funds to personal use.
b. Direct the Office of General Counsel to revise the Factual and Legal Analysis and pre-probable cause conciliation offer accordingly.
c. Authorize pre-probable cause conciliation with Randy Bryce and Randy Bryce for Congress and John Tate, III, in his official capacity as treasurer.
d. Approve the appropriate letters.
