DISPOSITION: The Commission failed by a vote of 3-3 to:
a. Dismiss the allegation under Heckler v. Chaney that Rick Scott violated 52 U.S.C. § 30102(e)(1) and 11 C.F.R. § 101.1(a) by failing to timely file his Statement of Candidacy.
b. Dismiss the allegation under Heckler v. Chaney that Rick Scott for Florida and Salvatore Purpura in his official capacity as treasurer violated 52 U.S.C. §§ 30103(a) and 30104 by failing to timely file a Statement of Organization.
c. Find no reason to believe that New Republican PAC and Gentry Collins in his official capacity as treasurer violated 52 U.S.C. § 30125(e) by soliciting, receiving, directing, transferring, or spending non-federal funds.
d. Dismiss the allegation that Rick Scott violated 52 U.S.C. § 30125(e) by soliciting, receiving, directing, transferring, or spending non-federal funds.
e. Dismiss the allegation that Rick Scott violated 52 U.S.C. §§ 30116(f), 30118(a), and 30125(e) by accepting impermissible and excessive in-kind contributions in the form of coordinated communications.
f. Dismiss the allegation that Rick Scott for Florida and Salvatore Purpura in his official capacity as treasurer violated 52 U.S.C. §§ 30104(b), 30116(f), 30118(a), and 30125(e) by accepting and failing to report impermissible and excessive in-kind contributions in the form of coordinated communications.
g. Dismiss the allegation that New Republican PAC and Gentry Collins in his official capacity as treasurer violated 52 U.S.C. §§ 30104(b), 30116(a), 30118(a), and 30125(e) by making and failing to report impermissible and excessive in-kind contributions in the form of coordinated communications.
h. Close the file.
i. Send the appropriate letters.
The Commission decided by a vote of 5-1 to:
a. Close the file.
b. Issue appropriate letters.
The Commission failed by a vote of 3-3 to take the following actions in MURs
7370 and 7496:
1. Find reason to believe that Rick Scott violated 52 U.S.C. § 30102(e)(1) and 11
C.F.R. § 101.1(a) by failing to timely file his Statement of Candidacy.
2. Find reason to believe that Rick Scott for Florida and Salvatore Purpura in his
official capacity as treasurer violated 52 U.S.C. §§ 30103(a) and 30104 by
failing to timely file a Statement of Organization.
3. Find reason to believe that New Republican PAC and Gentry Collins in his
official capacity as treasurer violated 52 U.S.C. § 30125(e) by soliciting,
receiving, directing, transferring, or spending non-federal funds.
4. Take no action at this time as to the allegation that Rick Scott violated 52
U.S.C. §§ 30116(f), 30118(a), and 30125(e) by accepting impermissible and
excessive in-kind contributions in the form of coordinated communications.
5. Take no action at this time as to the allegation that Rick Scott for Florida
and Salvatore Purpura in his official capacity as treasurer violated 52 U.S.C.
§§ 30104(b), 30116(f), 30118(a), and 30125(e) by accepting and failing to
report impermissible and excessive in-kind contributions in the form of
coordinated communications.
6. Take no action at this time as to the allegation that New Republican PAC and
Gentry Collins in his official capacity as treasurer violated 52 U.S.C. §§
30104(b), 30116(a), 30118(a), and 30125(e) by making and failing to report
impermissible and excessive in-kind contributions in the form of coordinated
communications.
7. Approve the appropriate portions of the Factual and Legal Analyses, as
recommended in the First General Counsel’s Report dated December 2, 2020.
8. Find reason to believe that Rick Scott violated 52 U.S.C. § 30125(e) by
soliciting, receiving, directing, transferring, or spending non-federal funds.
9. Authorize the use of compulsory process.
10. Send the appropriate letters.
