DISPOSITION: The Commission failed by a vote of 3-3 to:
a. Find no reason to believe that Remember Mississippi and Tommy Barnett in his official capacity as treasurer violated 52 U.S.C. §§ 30104(b), 30116 and 30118(a) by making prohibited, excessive, and unreported in-kind contributions to McDaniel and Friends of Chris McDaniel with respect to events in March 2018.
b. Find no reason to believe that Chris McDaniel violated 52 U.S.C §§ 30116(f), 30118(a) and 30125(e) by accepting prohibited and excessive in-kind contributions from Remember Mississippi.
c. Find no reason to believe that Friends of Chris McDaniel and Richard Conrad in his official capacity as treasurer violated 52 U.S.C. §§ 30104(b), 30116(f), 30118(a) and 30125(e) by accepting prohibited, excessive, and unreported in-kind contributions from Remember Mississippi.
d. Find no reason to believe that Chris McDaniel violated 52 U.S.C. § 30102(e)(1) by failing to timely file a Statement of Candidacy and designate a principal committee.
e. Find no reason to believe that Friends of Chris McDaniel and Richard Conrad in his official capacity as treasurer violated 52 U.S.C. §§ 30103(a) and 30104(a) by failing to timely file a Statement of Organization and failing to file a 2017 Year-End Report.
f. Find no reason to believe that Chris McDaniel violated 52 U.S.C. § 30125(e) by establishing, financing, maintaining, or controlling Remember Mississippi.
g. Close the file.
h. Send the appropriate letters.
The Commission decided by a vote of 6-0 to:
a. Close the file.

The Commission failed by a vote of 3-3 to:
a. Find reason to believe that Remember Mississippi and Tommy Barnett in his official capacity as treasurer violated 52 U.S.C. §§ 30104(b), 30116 and 30118(a) by making prohibited, excessive, and unreported in-kind contributions to McDaniel and Friends of Chris McDaniel with respect to events in March 2018.
b. Find reason to believe that Chris McDaniel violated 52 U.S.C §§ 30116(f), 30118(a) and 30125(e) by accepting prohibited and excessive in-kind contributions from Remember Mississippi.
c. Find reason to believe that Friends of Chris McDaniel and Richard Conrad in his official capacity as treasurer violated 52 U.S.C. §§ 30104(b), 30116(f), 30118(a) and 30125(e) by accepting prohibited, excessive, and unreported in-kind contributions from Remember Mississippi.
d. Approve the appropriate portions of the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated June 26, 2019.
e. Authorize the use of compulsory process.

The Commission failed by a vote of 2-4 to:
a. Find reason to believe that Chris McDaniel violated 52 U.S.C. § 30102(e)(1) by failing to timely file a Statement of Candidacy and designate a principal committee.
b. Find reason to believe that Friends of Chris McDaniel and Richard Conrad in his official capacity as treasurer violated 52 U.S.C. §§ 30103(a) and 30104(a) by failing to timely file a Statement of Organization and failing to file a 2017 Year-End Report.
c. Approve the appropriate portions of the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated June 26, 2019.
d. Find reason to believe that Chris McDaniel violated 52 U.S.C. § 30125(e) by establishing, financing, maintaining, or controlling Remember Mississippi.
e. Direct the Office of General Counsel to draft the appropriate Factual and Legal Analysis consistent with the finding in 2(d).
The Commission failed by a vote of 1-5 to:
a. Take no action at this time with respect to the allegation that Chris McDaniel violated 52 U.S.C. § 30125(e) by establishing, financing, maintaining, or controlling Remember Mississippi.
b. Approve the appropriate portions of the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated June 26, 2019.
c. Take no action at this time as to the allegation that Chris McDaniel violated 52 U.S.C. § 30102(e)(1) by failing to timely file a Statement of Candidacy and designate a principal campaign committee.
d. Take no action at this time as to the allegation that Friends of Chris McDaniel and Richard Conrad in his official capacity as treasurer violated 52 U.S.C. §§ 30103(a) and 30104(a) by failing to timely file a Statement of Organization and failing to file a 2017 Year-End Report.
e. Direct the Office of General Counsel to draft the appropriate Factual and Legal Analyses.
