DISPOSITION: The Commission failed by a vote of 3-3 to:
a. Find no probable cause to believe that Mark Takai for Congress and Dylan Beesley in his official capacity as treasurer violated 52 U.S.C. § 30114(b) by converting campaign funds to personal use.
b. Find no probable cause to believe that Dylan Beesley and Lanakila Strategies, LLC violated 52 U.S.C. § 30114(b) by converting campaign funds to personal use.
c. Close the file.
d. Send the appropriate letters.
The Commission decided by a vote of 4-2 to:
a. Find no probable cause to believe that Mark Takai for Congress and Dylan Beesley in his official capacity as treasurer violated 52 U.S.C. § 30114(b) by converting campaign funds to personal use.
b. Find no probable cause to believe that Dylan Beesley and Lanakila Strategies, LLC violated 52 U.S.C. § 30114(b) by converting campaign funds to personal use.
The Commission decided by a vote of 6-0 to:
a. Close the file.
b. Issue appropriate letters.
The Commission decided by a vote of 6-0 to take the following actions in MUR 7310:
1. Authorize pre-probable cause conciliation for a period not to exceed 30 days from the date the Commission’s conciliation offers are served, unless Respondents agree to tolling, and approve the conciliation agreement with Mark Takai for Congress and Dylan Beesley in his official capacity as treasurer, Dylan Beesley, and Lanakila Strategies, LLC., as recommended in the Second General Counsel’s Report dated December 3, 2021.
2. Approve the appropriate letters.
The Commission decided by a vote of 6-0, on an amended pre-meeting tally, to approve the Order to Submit Written Answers and Subpoena to Produce Documents directed to Mark Takai for Congress and Dylan Beesley in his official capacity as treasurer (the “Committee”) and Dylan Beesley and Lanakila Strategies, LLC (“Lanakila”), as recommended in the Memorandum to the Commission dated June 22, 2021.
The Commission decided by a vote of 4-0, on an amended pre-meeting tally, to:
1. Find reason to believe that Mark Takai for Congress and Dylan Beesley in his official capacity as treasurer violated 52 U.S.C. § 30114(b).
2. Find reason to believe that Lanakila Strategies LLC violated 52 U.S.C. § 30114(b).
3. Find reason to believe that Dylan Beesley in his personal capacity violated 52 U.S.C. § 30114(b).
4. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated June 28, 2018, subject to:
a. the edits to the Takai Factual and Legal Analysis last circulated by Chair Weintraub’s office at 3:43 p.m. on June 3, 2019; and
b. the edits to the Lanakila Factual and Legal Analysis last circulated by the offices of Vice Chairman Petersen and Commissioner Hunter at 11:01 a.m. on June 3, 2019.
5. Authorize compulsory process.
6. Approve the appropriate letters.
