The Commission decided by a vote of 4-0 to approve the Deposition Subpoenas,
Orders to Submit Written Answers, and Subpoenas to Produce Documents directed
to Alexandra Chalupa and Andrii Telizhenko, and the Order to Submit Written
Answers and Subpoena to Produce Documents directed to the Democratic National
Committee and William Derrough in his official capacity as treasurer, as
recommended in the Memorandum to the Commission dated August 28, 2019.
The Commission decided by a vote of 4-0 to:
1. Find reason to believe that the Democratic National Committee and William
Derrough in his official capacity as treasurer, Alexandra Chalupa, and Chalupa
& Associates LLC violated 52 U.S.C. § 30121(a)(2) and 11 C.F.R. § 110.20(g).
2. Approve the use of compulsory process.
3. Approve the Factual and Legal Analyses, as recommended in the First General
Counsel’s Report dated March 15, 2019, and as last circulated by Chair
Weintraub’s Office on July 24, 2019 at 10:01 p.m.
4. Approve the appropriate letters.
The Commission failed by a vote of 2-0 to:
1. Find reason to believe that the Democratic National Committee and William Derrough in his official capacity as treasurer, Alexandra Chalupa, and Chalupa & Associates LLC violated 52 U.S.C. § 30121(a)(2) and 11 C.F.R. § 110.20(g).
2. Approve the use of compulsory process.
3. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated March 15, 2019, subject to the edits last circulated by Chair Weintraub’s Office on April 23, 2019 at 3:56 p.m.
4. Approve the appropriate letters.
