COMPLAINANT:
SUBJECT: Disbursements; Other; Reporting
DISPOSITION: The Commission decided by a vote of 4-1 to take the following actions in MUR 7256:
1. Accept the signed conciliation agreement with The Council
of Insurance Agents & Brokers PAC and Ken A. Crerar in his official capacity as
treasurer, as recommended in the Memorandum to the Commission dated September 27, 2017.
2. Approve the appropriate letters.
3. Close the file.
The Commission failed by a vote of 2-3 to:
a. Open a MUR.
b. Find reason to believe that Council of Insurance Agents & Brokers PAC, and Ken A. Crerar acting in his official capacity as treasurer violated 52 U.S.C. § 30104(b)(3) and (4).
c. Find reason to believe that Council of Insurance Agents & Brokers PAC, and Ken A. Crerar acting in his official capacity as treasurer violated 52 U.S.C. § 30102(a), and direct the Office of General Counsel to amend the proposed conciliation agreement and Factual and Legal Analysis accordingly.
d. Enter into pre-probable cause conciliation with Council of Insurance Agents & Brokers PAC, and Ken A. Crerar acting in his official capacity as treasurer, prior to a finding of probable cause.
e. Approve the appropriate Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated May 23, 2017 subject to the proposed amendment made by Commissioner Weintraub at the table.
f. Approve the conciliation agreement, as recommended in the First General Counsel’s Report dated May 23, 2017 subject to the proposed amendment made by Commissioner Weintraub at the table.
g. Approve the appropriate letters
The Commission decided by a vote of 4-1 to:
a. Open a MUR.
b. Find reason to believe that Council of Insurance Agents & Brokers PAC, and Ken A. Crerar acting in his official capacity as treasurer violated 52 U.S.C. § 30104(b)(3) and (4).
c. Enter into pre-probable cause conciliation with Council of Insurance Agents & Brokers PAC, and Ken A. Crerar acting in his official capacity as treasurer, prior to a finding of probable cause.
d. Approve the appropriate Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated May 23, 2017.
e. Approve the conciliation agreement, as recommended in the First General Counsel’s Report dated May 23, 2017 . . . .
