DISPOSITION: The Commission failed by a vote of 1-5 to:
a. Dismiss the allegation that Greg Gianforte and Greg for Montana and Lorna Kuney in her official capacity as treasurer violated 52 U.S.C. § 30116(f).
b. Dismiss the allegation that Gianforte Victory Fund and Chris Marston in his official capacity as treasurer failed to return excessive contributions in violation of 11 C.F.R. § 102.17(c)(6).
c. Dismiss the allegation that Greg for Montana and Lorna Kuney in her official as treasurer, Montana Republican State Central Committee and Mike Hopkins in his official capacity as treasurer, and NRCC and Keith Davis in his official capacity as treasurer, violated 52 U.S.C. § 30116(a)(8) and 11 C.F.R. § 110.6(c).
d. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated February 6, 2020, subject to the edits last circulated by Chair Broussard’s Office on August 23, 2021 at 6:34 p.m.
e. Approve the appropriate letters.
f. Close the file.
The Commission failed by a vote of 3-3 to:
a. Find no reason to believe that Greg Gianforte and Greg for Montana and Lorna Kuney in her official capacity as treasurer violated 52 U.S.C. § 30116(f).
b. Find no reason to believe that Gianforte Victory Fund and Chris Marston in his official capacity as treasurer failed to return excessive contributions in violation of 11 C.F.R. § 102.17(c)(6).
c. Find no reason to believe that Greg for Montana and Lorna Kuney in her official as treasurer, Montana Republican State Central Committee and Mike Hopkins in his official capacity as treasurer, and NRCC and Keith Davis in his official capacity as treasurer, violated 52 U.S.C. § 30116(a)(8) and 11 C.F.R. § 110.6(c).
d. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated February 6, 2020, subject to the edits last circulated by Commissioner Cooksey’s Office on August 27, 2021 at 3:46 p.m.
e. Approve the appropriate letters.
f. Close the file.
