DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MUR 7225:
1. Accept the conciliation agreement with Jack Wenpo Wu, as Recommended in the Memorandum from the Acting General Counsel dated April 12, 2019.
2. Approve the appropriate letter.
3. Close the file.
The Commission decided by a vote of 5-0, on an amended pre-meeting tally, to:
1. Enter into pre-probable cause conciliation with Jack Wu.
2. Approve the proposed conciliation agreement, as recommended in the Second General Counsel’s Report dated January 10, 2018.
3. Approve the appropriate letters.
The Commission failed by a vote of 2-3 to:
a. Open a MUR.
b. Take no action at this time with respect to Rohrabacher for Congress and Jen
Slater in her official capacity as treasurer.
c. Find reason to believe that Jack Wu knowingly and willfully violated 52
U.S.C. §§ 30102(b)(3) and (c), 30104(b), and 30114(b)(1) and 11 C.F.R.
§§ 102.9, 102.15, and 104.3.
d. Authorize the use of compulsory process, as necessary.
e. Approve the Factual and Legal Analyses, as recommended in the First General
Counsel’s Report dated February 2, 2017, subject to its appropriateness in the
context of the entirety of the motion.
f. Approve the appropriate letters.
The Commission decided by a vote of 5-0 to:
a. Open a MUR.
b. Refer Rohrabacher for Congress and Jen Slater in her official capacity as
treasurer, to the Alternative Dispute Resolution Office (ADRO) for the alleged
violations of 52 U.S.C. §§ 30102(c) and 30104(b) and 11 C.F.R. §§ 102.9 and
104.3, with the understanding that ADRO will refrain from processing the case
until such time as the investigation conducted by the Office of General Counsel
is complete.
c. Find reason to believe that Jack Wu knowingly and willfully violated 52
U.S.C. §§ 30102(b)(3) and (c), 30104(b), and 30114(b)(1) and 11 C.F.R.
§§ 102.9, 102.15, and 104.3.
d. Authorize the use of compulsory process, as necessary.
e. Approve the Factual and Legal Analyses, as recommended in the First General
Counsel’s Report dated February 2, 2017.
f. Approve the appropriate letters.
