DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MURs
7190 and 7208:
1. Accept the conciliation agreement, as recommended in the Memorandum to the
Commission dated February 21, 2020.
2. Approve the appropriate letters.
3. Close the file.
The Commission failed by a vote of 2-2 to:
a. Find reason to believe that Alaska Republican Party and Donald Handeland in his official capacity as treasurer violated 52 U.S.C. §§ 30104(b) and 30116(a) in connection with the absentee ballot mailer and the voter targeting.
b. Find reason to believe that Tuckerman Babcock and Rick Whitbeck violated 52 U.S.C. § 30116(a) in connection with the absentee ballot mailer and the voter targeting.
c. Find reason to believe that Lisa Murkowski and Lisa Murkowski for U.S. Senate and Catherine Straub in her official capacity as treasurer violated 52 U.S.C. §§ 30116(f) and 30104(b) in connection with absentee ballot mailer and the voter targeting.
The Commission failed by a vote of 2-2 to:
a. Find no reason to believe that Alaska Republican Party and Donald Handeland in his official capacity as treasurer violated 52 U.S.C. § 30104(b).
b. Find no reason to believe that Lisa Murkowski for U.S. Senate and Catherine Straub in her official capacity as treasurer violated 52 U.S.C. § 30104(b).
c. Find no reason to believe that Alaska Republican Party and Donald Handeland in his official capacity as treasurer, Tuckerman Babcock, or Rick Whitbeck violated 52 U.S.C. § 30116(a).
d. Find no reason to believe that Lisa Murkowski or Lisa Murkowski for U.S. Senate and Catherine Straub in her official capacity as treasurer violated 52 U.S.C. § 30116(f).
e. Find reason to believe that Alaska Republican Party and Donald Handeland in his official capacity as treasurer violated 52 U.S.C. § 30120 and 11 C.F.R. § 110.11(d)(2).
f. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated February 15, 2019, subject to the edits circulated by Vice Chairman Petersen’s Office on August 15, 2019 at 4:25 p.m.
g. Enter into conciliation with Alaska Republican Party and Donald Handeland in his official capacity as treasurer prior to a finding of probable cause to believe.
h. Approve the conciliation agreement with Alaska Republican Party and Donald Handeland in his official capacity as treasurer.
i. Approve the appropriate letters.
The Commission decided by a vote of 4-0 to:
a. Find no reason to believe that Alaska Republican Party and Donald Handeland in his official capacity as treasurer violated 52 U.S.C. § 30104(b) with respect to the transfers only.
b. Find no reason to believe that Lisa Murkowski for U.S. Senate and Catherine Straub in her official capacity as treasurer violated 52 U.S.C. § 30104(b) with respect to the transfers only.
c. Find reason to believe that Alaska Republican Party and Donald Handeland in his official capacity as treasurer violated 52 U.S.C. § 30120 and 11C.F.R. § 110.11(d)(2).
d. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated February 15, 2019, and the relevant portions circulated by Vice Chairman Petersen’s Office on August 15, 2019 at 4:25 p.m.
