Dismiss the complaint consistent with the Commission’s prosecutorial discretion to determine the proper ordering of its priorities and use of agency resources. Heckler v. Chaney, 470 U.S. 821, 831-32 (1985), as recommended in the EPS Dismissal Report dated November 22, 2017. 2. Direct the Office of General Counsel to prepare a Factual and Legal Analysis that mirrors the analysis in the EPS Dismissal Report . . . REDACTED . . . and that the Commission approve that Factual and Legal Analysis. 3. Close the file as to all Respondents. 4. Send the appropriate letters.
