DISPOSITION: The Commission failed by a vote of 2-3 to: a. Find reason to believe that NRCC and Keith A. Davis in his official capacity as treasurer violated 52 U.S.C. §§ 30104(b) and 30116(a) in connection with republishing campaign material. b. Find no reason to believe that Scott Jones or Sheriff Scott Jones for Congress and David Bauer in his official capacity as treasurer violated 52 U.S.C. § 30116(f). c. Find no reason to believe that NRCC and Keith A. Davis in his official capacity as treasurer violated 52 U.S.C. § 30116(a) in connection with a coordinated communication. d. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated August 7, 2017. e. Enter into conciliation with NRCC and Keith A. Davis in his official capacity as treasurer prior to a finding of probable cause to believe. f. Approve the proposed Conciliation Agreement, as recommended in the First General Counsel’s Report dated August 7, 2017. g. Approve the appropriate letters. h. Close the file as to Scott Jones and Sheriff Scott Jones for Congress and David Bauer in his official capacity as treasurer.
