DISPOSITION: The Commission decided by a vote of 5-0 to: 1. Dismiss the allegations that AJ Kern for Congress and John W. Kern in his official capacity as treasurer violated 52 U.S.C. § 30104(a)(2)(A) and 11 C.F.R. § 104.5(a) and send a letter of caution. 2. Find no reason to believe that John W. Kern violated 52 U.S.C. § 30116(a). 3. Find no reason to believe that AJ Kern for Congress and John W. Kern in his official capacity as treasurer violated 52 U.S.C. § 30116(f). 4. Dismiss the allegations that AJ Kern for Congress and John W. Kern in his official capacity as treasurer violated 52 U.S.C. § 30104(b)(3)(A) but send a letter of caution. 5. Find no reason to believe that John W. Kern and AJ Kern for Congress and John W. Kern in his official capacity as treasurer made violated 52 U.S.C. § 30123 and 11 C.F.R. § 110.4(c). 6. Dismiss the allegation that AJ Kern for Congress and John W. Kern in his official capacity as treasurer, Kevin Durken, and The Boot Shack, Inc. violated 52 U.S.C. § 30118(a) but send a letter of caution. 7. Find no reason to believe that AJ Kern for Congress and John W. Kern in his official capacity as treasurer violated 52 U.S.C. § 30102(i) and 11 C.F.R. § 104.7(a). 8. Dismiss the allegation that AJ Kern for Congress and John W. Kern in his official capacity as treasurer violated 52 U.S.C. § 30120(a)(1) and 11 C.F.R. § 110.11 but send a letter of caution. 9. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated June 15, 2017, with edits circulated by multiple people including most recently by Commissioner Weintraub’s Office on February 5, 2018 and with the edit made at the table . . .
