The Commission decided by a vote of 5-0 to take the following actions in MUR 7104:
1. Find reason to believe that Frederick John LaVergne for Congress and Leonard
Marshall in his official capacity as treasurer violated 52 U.S.C. § 30104(a), (b)(4) and 11 C.F.R. § 104.3(a), (b).
2. Find no reason to believe that Frederick John LaVergne violated 52 U.S.C. §
30104(a), (b)(4) and 11 C.F.R. § 104.3(a), (b).
3. Dismiss the allegation that Frederick John LaVergne for Congress and Leonard Marshall in his official capacity as treasurer violated 52 U.S.C. § 30120(a)(1)
and (c)(2) and 11 C.F.R. § 110.11(b)(1) and (c)(2) in connection with the contribution portion of its website.
4. Find no reason to believe that Frederick John LaVergne for Congress and Leonard Marshall in his official capacity as treasurer violated 52 U.S.C. §
30120(c)(2) and 11 C.F.R. § 110.11(c)(2) (ii) with regard to the disclaimer on the homepage of the Committee’s website.
5. Find no reason to believe that Frederick John LaVergne violated 52 U.S.C. § 30120(c)(2) and 11 C.F.R. § 110.11(c)(2)(iv).
6. Authorize the use of compulsory process.
7. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated March 6, 2017.
8. Approve the appropriate letters.
