SUBJECT: Reporting

DISPOSITION: The Commission decided by a vote of 5-0 to: 1. Find no reason to believe that Margaret for Alaska and Tim Pearson in his official capacity as treasurer violated 52 U.S.C. § 30104(a). 2. Dismiss the allegation that Alaska Democratic Party and Carolyn Covington in her official capacity as treasurer, Margaret Stock, and Margaret for Alaska and Tim Pearson in his official capacity as treasurer violated 52 U.S.C. § 30104(b) pursuant to the Commission’s prosecutorial discretion under Heckler v. Chaney, 470 U.S. 821 (1985). 3. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated November 22, 2017, as last circulated by Wanda Brown and with the edit to footnote 16 noted at the table. 4. Approve the appropriate letters. 5. Close the file.
The Commission decided by a vote of 4-1 to authorize and direct the Office of General Counsel to call the respondents’ counsels, memorialize the conversation or response with a memorandum to file, and report back to the Commission. The Commission can then refer the matter to the Alternative Dispute Resolution Office for reporting issues or consider a substantive violation of any in-kind contribution.
