DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MUR
7048:
1. Accept the conciliation agreement, as recommended in the Memorandum to the
Commission dated June 18, 2020.
2. Dismiss the allegation that J. Keet Lewis violated 52 U.S.C. § 30125(e) and 11
C.F.R. § 300.61.
3. Dismiss the allegation that Senator Ted Cruz violated 52 U.S.C. § 30125(e) and 11 C.F.R. § 300.61.
4. Approve the appropriate letters.
5. Close the file.
The Commission failed by a vote of 2-2 to:
a. Find reason to believe that J. Keet Lewis violated 52 U.S.C. § 30125(e) and 11 C.F.R. §300.61.
b. Enter into conciliation with J. Keet Lewis and Cruz for President and Bradley S. Knippa in his official capacity as treasurer prior to a finding of probable cause to believe.
c. Approve the Conciliation Agreement subject to directing the Office of General Counsel to add J. Keet Lewis.
d. Approve the Factual and Legal Analysis subject to directing the Office of General Counsel to add the reason to believe finding against J. Keet Lewis and
an explanation therefore.
The Commission decided by a vote of 4-0 to:
a. Find reason to believe that Cruz for President and Bradley S. Knippa in his official capacity as treasurer violated 52 U.S.C. § 30125(e) and 11 C.F.R. § 300.61.
b. Enter into conciliation with Cruz for President and Bradley S. Knippa in his official capacity as treasurer prior to a finding of probable cause to believe.
c. Take no action at this time as to the allegation that J. Keet Lewis violated 52 U.S.C. § 30125(e) and 11 C.F.R. § 300.61.
d. Take no action at this time as to the allegation that Senator Ted Cruz violated 52 U.S.C. § 30125(e) and 11 C.F.R. § 300.61.
e. Find no reason to believe that Cruz for President and Bradley S. Knippa in his official capacity as treasurer violated 11 C.F.R. § 102.17.
f. Find no reason to believe that Stand for Truth, Inc. and D. Eric Lycan in his official capacity as treasurer violated 11 C.F.R. § 102.17, and close the file as to them.
g. Approve the Conciliation Agreement, as recommended in the First General Counsel’s Report dated March 5, 2019.
h. Approve the Factual & Legal Analyses, as recommended in the First General Counsel’s Report dated March 5, 2019, subject to the edits described at the
table by Commissioner Hunter.
i. Approve the appropriate letters.
