DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MUR 7028:1. Accept the joint conciliation agreement with Plumbers and Pipefitters Local Union No. 9, and Plumbers and Pipefitters Local Union No. 9 PAC and Mike Maloney in his official capacity as treasurer, as recommended in the Memorandum from the Acting General Counsel dated October 10, 2018.2. Approve the appropriate letters.3. Close the file.
The Commission decided by a vote of 4-0, on an amended pre-meeting tally, to:1. Enter into pre-probable cause conciliation with Plumbers and Pipefitters Local Union No. 9 and Plumbers and Pipefitters Local Union No. 9 PAC and Michael Maloney in his official capacity as treasurer.2. Approve the joint conciliation agreement, as recommended in the Second General 2Counsel’s Report dated June 28, 2018.3. Approve the appropriate letters.
The Commission decided by a vote of 5-0, subject to the proposed language emailed by the Office General Counsel on March 21, 2017 at 1:25 p.m., and the edits proposed by Commissioners Petersen and Weintraub at the table, to take the following actions in MUR 7028: 1. Find reason to believe that Plumbers and Pipefitters Local Union No. 9 violated 52 U.S.C. § 30118(b)(3)(A)-(C) and 11 C.F.R. § 114.5(a)(2)-(5).2. Find reason to believe that Plumbers and Pipefitters Local Union No. 9 Political Action Committee and Michael Maloney in his official capacity as treasurer violated 52 U.S.C. § 30118(b)(3)(A) and 11 C.F.R. §114.5(a)(2)-(5).3. Authorize the use of compulsory process.4. Approve the Factual and Legal Analysis as recommended in the First General Counsel’s Report dated December 15, 2016.5. Approve the appropriate letters.
