DISPOSITION: The Commission decided by a vote of 5-0 to take the following actions in MUR 7027: 1. Take no further action as to Brad Cornelsen. 2. Approve the appropriate letters. 3. Close the file.
The Commission decided by a vote of 6-0 to: a. Accept the conciliation agreement with MV Transportation, Inc. as recommended in the Memorandum from the Acting Associate General Counsel for Enforcement dated October 11, 2016. b. Approve the appropriate letter with respect to MV Transportation, Inc. c. Close the file as to MV Transportation, Inc.
The Commission decided by a vote of 5-1 to: a. Accept the conciliation agreement with R. Carter Pate, as recommended in the Memorandum from the Acting Associate General Counsel for Enforcement dated October 11, 2016. b. Approve the appropriate letter. c. Close the file as to R. Carter Pate.
The Commission failed by a vote of 3-3 to: a. Open a Matter Under Review. b. Find reason to believe that MV Transportation, Inc. knowingly and willfully violated 52 U.S.C. § 30122 and 11 C.F.R. § 110.4(b)(1)(i). c. Find reason to believe that R. Carter Pate knowingly and willfully violated 52 U.S.C. § 30122 and 11 C.F.R. § 110.4(b)(1)(i) and (ii). d. Find reason to believe that Brad Cornelsen violated 52 U.S.C. § 30122 and 11 C.F.R. § 110.4(b)(1)(iii). e. Find reason to believe that MV Transportation, Inc. knowingly and willfully violated 52 U.S.C. § 30118(a) and 11 C.F.R. § 114.2(b). f. Find reason to believe that R. Carter Pate knowingly and willfully violated 52 U.S.C. § 30118(a) and 11 C.F.R. § 114.2(e). g. Find reason to believe that Brad Cornelsen violated 52 U.S.C. § 30118(a) and 11 C.F.R. § 114.2(e). h. Find reason to believe that MV Transportation, Inc. knowingly and willfully violated 52 U.S.C. § 30119(a) and 11 C.F.R. § 115.2. i. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated February 10, 2016. j. Authorize pre-probable cause conciliation with MV Transportation, Inc., R. Carter Pate, and Brad Cornelsen. k. Approve the proposed conciliation agreements, as recommended in the First General Counsel’s Report dated February 10, 2016. l. Approve the appropriate letters.

Find reason to believe that R. Carter Pate knowingly and willfully violated 52 U.S.C. § 30122 and 11 C.F.R. § 110.4(b)(1)(i) and (ii). d. Find reason to believe that Brad Cornelsen violated 52 U.S.C. § 30122 and 11 C.F.R. § 110.4(b)(1)(iii). e. Find reason to believe that MV Transportation, Inc. violated 52 U.S.C. § 30118(a) and 11 C.F.R. § 114.2(b). f. Find reason to believe that R. Carter Pate knowingly and willfully violated 52 U.S.C. § 30118(a) and 11 C.F.R. § 114.2(e). g. Find reason to believe that Brad Cornelsen violated 52 U.S.C. § 30118(a) and 11 C.F.R. § 114.2(e). h. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated February 10, 2016 with modifications to the relevant portions of the Factual and Legal Analysis as discussed at the Table. j. Authorize pre-probable cause conciliation with MV Transportation, Inc., R. Carter Pate, and Brad Cornelsen. k. Approve the proposed conciliation agreements, as recommended in the First General Counsel’s Report dated February 10, 2016 with modifications to the out-the-door offer to reflect the changes as discussed at the Table. l. Approve the appropriate letters.
