DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MUR
6993:
Accept the signed conciliation agreement with Van Hollen for Senate and Stacey
Maud in her official capacity as treasurer, as recommended in the Memorandum from the Acting General Counsel dated March 13, 2017.
Approve the appropriate letter.
Close the file.
The Commission decided by a vote of 6-0 to:
1. Approve the revised Factual and Legal Analysis for Van Hollen for Senate and Stacey Maud in her official capacity as treasurer as recommended in the Memorandum from the Office of General Counsel dated November 9, 2016, subject to the edits last circulated by the Office of General Counsel at 2:15 p.m. on November 15, 2016.
2. Approve the revised conciliation agreement for Van Hollen for Senate and Stacey Maud in her official capacity as treasurer as recommended in the Memorandum from the Office of General Counsel dated November 9, 2016, subject to the edits as discussed at the Table.
3. Authorize technical and conforming edits.
The Commission decided by a vote of 6-0 to:
a. Find reason to believe that Van Hollen for Senate and Stacey Maud
in her official capacity as treasurer violated 52 U.S.C. § 30111(a)(4)
and 11 C.F.R. § 104.15.
b. Dismiss the allegation that Van Hollen for Senate and Stacey Maud
in her official capacity as treasurer violated 52 U.S.C. § 30120(a) and
11 C.F.R. § 110.11(a), pursuant to the Commission’s prosecutorial
discretion under Heckler v. Chaney, 470 U.S. 821 (1985).
c. Find no reason to believe that Rosalyn Levy Jonas violated
52 U.S.C. § 30116(a)(1)(A), and close the file as to her.
d. Enter into conciliation with Van Hollen for Senate and Stacey Maud
in her official capacity as treasurer prior to a finding of probable
cause
to believe.
e. Direct the Office of General Counsel to revise the Factual and Legal
Analysis and Conciliation Agreement for Van Hollen for Senate and
Stacey Maud in her official capacity as treasurer in accordance with
the meeting discussion.
f. Approve the appropriate letter.
The Commission decided by a vote of 6-0 to:
Approve the Factual and Legal Analysis with respect to Rosalyn Levy Jonas
as prepared by the Office of General Counsel.
