DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MURs 6960 & 6991:
1. Accept the signed conciliation agreement with SW Technologies, LLC, as recommended in the Memorandum to the Commission dated August 8, 2019.
2. Approve the appropriate letter.
3. Close the file.
The Commission decided by a vote of 4-0 to:
1. Enter into pre-probable cause conciliation with SW Technologies, LLC.
2. Approve the proposed conciliation agreement, as recommended in the Second General Counsel’s Report dated May 30, 2019.
3. Dismiss the allegations that Roger A. Stone violated 52 U.S.C. § 30111(a)(4).
4. Approve the factual and legal analysis for Roger A. Stone, as recommended in the Second General Counsel’s Report dated May 30, 2019.
5. Close the file as to Roger A. Stone.
6. Approve the appropriate letters.
The Commission failed by a vote of 2-3 to:
a. Find reason to believe that SW Technologies, LLC violated 52 U.S.C. § 30111(a)(4).
b. Take no action at this time as to the allegations that Roger A. Stone violated 52 U.S.C. § 30111(a)(4).
c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated April 18, 2017.
d. Authorize the use of compulsory process.
e. Approve the appropriate letters.
The Commission decided by a vote of 5-0 to:
a. Find reason to believe that SW Technologies, LLC violated 52 U.S.C. § 30111(a)(4).
b. Take no action at this time as to the allegations that Roger A. Stone violated 52 U.S.C. § 30111(a)(4).
c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated April 18, 2017, except delete the paragraph discussed at
the table.
d. Authorize the use of compulsory process.
e. Approve the appropriate letters.
