DISPOSITION: The Commission decided by a vote of 4-2 to take the following actions in MUR 6987:
Accept the conciliation agreement with Florida Freedom PAC and Gihan J. Perera in his official capacity as treasurer, as recommended in the Memorandum to the Commission dated December 23, 2016.
Approve the appropriate letter.
Close the file.
The Commission failed by a vote of 3-3 to:
a. Accept the conciliation agreement with Florida Freedom PAC and Gihan J.
Perera in his official capacity as treasurer as recommended in the Memorandum
to the Commission from the Acting General Counsel dated June 24, 2016.
b. Approve the appropriate letter.
c. Close the file.
The Commission decided by a vote of 4-2 to:
a. Approve the conciliation agreement with Florida Freedom PAC and Gihan J.
Perera in his official capacity as treasurer as recommended in the Memorandum
to the Commission from the Acting General Counsel dated June 24, 2016,
as amended by Commissioner Goodman’s Office on December 5, 2016.
b. Authorize the Office of General Counsel to propose the amended
conciliation agreement as a counter offer to the respondents.
The Commission failed by a vote of 3-3 to:
a. Open a MUR in RR 15L-13.
b. Find reason to believe that Florida Freedom PAC and Gihan J. Perera
in his official capacity as treasurer violated 52 U.S.C. § 30104(g).
c. Authorize conciliation with Florida Freedom PAC and Gihan J. Perera
in his official capacity as treasurer prior to a finding of probable cause
to believe.
d. Approve the Factual and Legal Analysis, as recommended in the First
General Counsel’s Report dated October 15, 2015.
e. Approve the Conciliation Agreement, as recommended in the First
General Counsel’s Report dated October 15, 2015.
f. Approve the appropriate letter.
The Commission decided by a vote of 6-0 to:
a. Open a MUR in RR 15L-13.
b. Find reason to believe that Florida Freedom PAC and Gihan J. Perera
in his official capacity as treasurer violated 52 U.S.C. § 30104(g).
c. Authorize conciliation with Florida Freedom PAC and Gihan J. Perera
in his official capacity as treasurer prior to a finding of probable cause
to believe.
d. Approve the Factual and Legal Analysis, as recommended in the First
General Counsel’s Report dated October 15, 2015.
e. Approve the Conciliation Agreement, as recommended in the First
General Counsel’s Report dated October 15, 2015, but modify the opening penalty
offer to $63,000.
f. Approve the appropriate letter.
