DISPOSITION: The Commission decided by a vote of 5-0 to:
Find no reason to believe that Project Veritas violated 52 U.S.C. §
30121(a)(2), 52 U.S.C. § 30122, 11 C.F.R.§ 110.4(b)(i), (ii), and (iii), and 11
C.F.R. § 110.20(g).
The Commission failed by a vote of 1-4 to:
a. Dismiss the allegations that James O’Keefe violated 52 U.S.C. § 30121(a)(2),
52 U.S.C. § 30122, 11 C.F.R. § 110.4(b)(i), (ii), and (iii), and 11 C.F.R. §
110.20(g).
b. Direct the Office of General Counsel to draft a Factual and Legal Analysis
supporting that dismissal on the grounds of Heckler v. Chaney.
The Commission decided by a vote of 4-1 to:
Find no reason to believe that James O’Keefe violated 52 U.S.C. § 30121(a)(2),
52 U.S.C. § 30122, 11 C.F.R. § 110.4(b)(i), (ii), and (iii), and 11 C.F.R. §
110.20(g).
The Commission decided by a vote of 5-0 to:
a. Dismiss the allegations that Hillary for America and Jose Villarreal in his
official capacity as treasurer and Molly Barker violated 52 U.S.C. §
30121(a)(2), 52 U.S.C. § 30122, 11 C.F.R. § 110.4(b)(iv), and 11 C.F.R. §
110.20(g).
b. Find no reason to believe that Hillary Rodham Clinton violated 52 U.S.C. §
30121(a)(2), 52 U.S.C. § 30122, 11 C.F.R. § 110.4(b)(iv), and 11 C.F.R. §
110.20(g).
c. Dismiss the allegations that Project Veritas Action Fund and Laura Loomer
violated 52 U.S.C. § 30121(a)(2), 52 U.S.C. § 30122, 11 C.F.R. § 110.4(b)(i),
(ii), and (iii), and 11 C.F.R. § 110.20(g).
d. Dismiss the allegations that the Unknown Respondent violated 52 U.S.C. §
30121(a)(1)(A), 52 U.S.C. § 30122, 11 C.F.R. § 110.4(b)(i), and 11 C.F.R. §
110.20(g).
e. Approve the Factual and Legal Analysis, as recommended in the First General
Counsel’s Report dated January 18, 2017 subject to the edits last circulated by
Commissioner Petersen’s office on June 20, 2017 at 4:24 P.M., and as it relates
to the portions of the Factual and Legal analysis not covered in earlier
motions.
f. Approve the appropriate letters.
g. Close the files.
