DISPOSITION: The Commission failed by a vote of 3-3 to: a. Find reason to believe that Carolina Rising, Inc. violated 52 U.S.C. §§ 30102, 30103, and 30104 by failing to organize, register, and report as a political committee or, in the alternative to find reason to believe that Carolina Rising, Inc. violated 52 U.S.C. § 30104(f) and 11 C.F.R. § 104.20 by failing to disclose the donors behind its advertising. b. Direct the Office of General Counsel to prepare a Factual and Legal Analysis consistent with these findings. c. Authorize the use of compulsory process in this matter. d. Approve the appropriate letters.
The Commission failed by a vote of 3-3 to: a. Find no reason to believe that Carolina Rising, Inc. violated 52 U.S.C. § 30104(f) and 11 C.F.R. § 104.20. b. Approve the Factual and Legal Analysis as recommended in the First General Counsel's Report dated September 12, 2016. c. Approve the appropriate letters. d. Close the file.
The Commission decided by a vote of 4-1 to: Close the file.
