DISPOSITION: The Commission decided by a vote of 6-0 to: 1. Dismiss the allegation that Respondents violated 52 U.S.C. § 30125(e)(1)(A) (formerly 2 U.S.C. § 441i(e)(1)(A)); and 11 C.F.R. § 110.3(d) by transferring state funds or assets to the Federal Committee through payments to campaignstaff and a consulting firm. 2. Dismiss the allegation that Friends of Buddy Carter for Senate and Mark Smith in his official capacity as treasurer (State Committee) violated 52 U.S.C. § 30125(e)(1)(A) (formerly 2 U.S.C. § 441i(e)(1)(A)); and 11 C.F.R. § 110.3(d) by making impermissible transfers to Buddy Carter for Congress. 3. Dismiss the allegation that Buddy Carter for Congress and Carlton H. Hodges in his official capacity as treasurer violated 52 U.S.C. § 30125(e)(1)(A) (formerly 2 U.S.C. § 441i(e)(1)(A) and 11 C.F.R. § 110.3(d) by accepting impermissible transfers from Friends of Buddy Carter for Senate. 4. Dismiss the allegation that Friends of Buddy Carter and Mark Smith in his official capacity as treasurer and Earl LeRoy ("Buddy") Carter violated 52 U.S.C. § 30125(e)(1)(B) (formerly 2 U.S.C. § 441i(e)(1)(B)) by raising impermissible funds in connection with a non-federal election. 5. Dismiss the allegation that Earl LeRoy ("Buddy") Carter violated 52 U.S.C. § 30125(e)(1)(A) and (formerly 2 U.S.C. § 441i(e)(1)(A)); and and 11 C.F.R. § 110.3(d). 6. Approve the Factual and Legal Analysis, as recommended in the FirstGeneral Counsel's Report dated October 30, 2014, last circulated by Commissioner Hunter's Office on 12/08/2014 and authorize OGC to make any necessary technical and conforming edits. 7. Approve the appropriate letter. 8. Close the file.
