DISPOSITION: The Commission failed by a vote of 2-3 to: a. Find reason to believe that the Texas Democratic Party and Gilberto Hinojosa in his official capacity as treasurer violated 52 U.S.C. § 30116(a) (formerly 2 U.S.C. § 441a(a)). b. Find reason to believe that the Texas Democratic Party and Gilberto Hinojosa in his official capacity as treasurer violated 52 U.S.C. § 30104(b) (formerly 2 U.S.C. § 434(b)). c. Find reason to believe that the Texas Democratic Party and Gilberto Hinojosa in his official capacity as treasurer violated 52 U.S.C. § 30120 (formerly 2 U.S.C. § 441d). d. Find reason to believe that Lampson for Congress and Lanell Wilson in his official capacity as treasurer violated 52 U.S.C. § 30116(f) (formerly 2 U.S.C. § 441a(f)). e. Authorize an investigation into whether Lampson for Congress's transfers to the Texas Democratic Party were designated to be used for campaign mailings in support of Lampson. f. Approve the Factual and Legal Analysis as recommended in the First General Counsel's Report dated May 24, 2013. g. Authorize the use of compulsory process in this matter. h. Approve the appropriate letters.
The Commission failed by a vote of 3-2 to: a . Dismiss the allegations that the Texas Democratic Party and Gilberto Hinojosa, in his official capacity as treasurer, violated 52 U.S.C. §§ 30116(a) (formerly 2 U.S.C. § 441a(a)), 30104(b)(formerly 2 U.S.C. § 434(b)), and 30120 (formerly 2 U.S.C. § 441d). b. Dismiss the allegation that Lampson for Congress and Lanell Wilson, in his official capacity as treasurer, violated 52 U.S.C. § 30116(f) (formerly 2 U.S.C. § 441a(f)). c. Approve the Factual and Legal Analysis as recommended in the First General Counsel's Report dated May 24, 2013, and as circulated by Commissioner Goodman's Office on 12/15/14 with the edits as discussed at the Table. d. Send the appropriate letters. e. Authorize the Office of General Counsel to make any necessary technical and conforming changes.
