SUBJECT: Reporting; Soft Money

DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 6624: Accept the signed conciliation agreement with Gould for Congress and Janice Gould in her official capacity as treasurer, as recommended in the Memorandum from the Acting General Counsel dated March 9, 2016. Approve the appropriate letters. Close the file.
The Commission failed by a vote of 3-3 to: a. Find reason to believe that the Committee to Elect Ron Gould and Janice Gould in her official capacity as treasurer violated 52 U.S.C. § 30125(e)(1)(A) and 11 C.F.R. § 110.3(d). b. Find reason to believe that Gould for Congress and Janice Gould in her official capacity as treasurer and Ron Gould violated 52 U.S.C. § 30125(e)(1)(A) and 11 C.F.R. § 110.3(d). c. Find reason to believe that Gould for Congress and Janice Gould in her official capacity as treasurer violated 52 U.S.C. § 30104(b). d. Take no action at this time with respect to Blue Point, LLC and Christopher Baker. e. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated July 31, 2014. f. Authorize the use of compulsory process. g. Approve the appropriate letters.
The Commission decided by a vote of 6-0 to: a. Find reason to believe that Gould for Congress and Janice Gould in her official capacity as treasurer violated 52 U.S.C. § 30104(b). b. Approve the appropriate sections of the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated July 31, 2014. c. Instruct the Office of General Counsel to draft an appropriate conciliation agreement with an out-the-door offer of the applicable statutory penalty. d. Approve the appropriate letters.
