DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MUR 6538R:
1. Accept the conciliation agreement with Americans for Job Security, as recommended in the Memorandum to the Commission dated August 29, 2019.
2. Approve the appropriate letter.
3. Close the file.
The Commission decided by a vote of 4-0 to:
1. Enter into pre-probable cause conciliation with Americans for Job Security.
2. Approve the Conciliation Agreement, as recommended in the Second General Counsel’s Report dated February 15, 2019, and as last circulated by Chair Weintraub’s Office at 1:31 p.m. on March 26, 2019.
3. Approve the appropriate letter.
The Commission decided by a vote of 4-0 to authorize the subpoena for service on the Fair Political Practices Commission (FPPC), as recommended in the Memorandum from the Acting General Counsel dated August 2, 2018, subject to the
edits circulated by Chair Hunter’s Office on September 5, 2018 at 5:28 p.m.
The Commission decided by a vote of 5-0, on an amended pre-meeting tally, to approve the Subpoena to Produce Documents and Order to Submit Written Answers to Stephen DeMaura and a Deposition Subpoena to Stephen DeMaura, as recommended in the Memorandum from the Acting General Counsel dated January 12, 2018.
The Commission decided by a vote of 5-0 to approve the Subpoena to Produce
Documents and Order to Submit Written Answers to Americans for Job Security and
Stephen DeMaura, and Subpoenas to Produce Documents for Citibank and United
Bank, as recommended in the Memorandum from the Acting General Counsel dated
November 1, 2017.
The Commission decided by a vote of 4-1 to take the following actions in MUR 6538R:
1. Deem withdrawn the motion made by Commissioner Goodman in the Executive Session of June 6 and 8, 2017 that was pending when the Executive Session lost its quorum on June 8, 2017.
2. Add to the record of the matter the Concurring Statement of Reasons of Commissioner Lee E. Goodman, and direct the Office of General Counsel to provide a copy of the Statement to respondents forthwith.
3. Determine that the Commission’s action in this matter shall not be considered as precedent for accompanying documents with, attaching documents to, or in any
way supplementing, the Factual and Legal Analysis in future enforcement proceedings.
The Commission decided by a vote of 4-1 to approve the Factual and Legal Analysis as circulated by Commissioner Petersen’s office on April 26, 2017 at 3:58 p.m.
The Commission decided by a vote of 6-0 to take the following actions:
1. Find reason to believe that Americans for Job Security violated 52 U.S.C. §§ 30102, 30103, and 30104.
2. Authorize the use of compulsory process.
3. Approve the appropriate letter.
