DISPOSITION: The Commission decided by at vote of 4-0 to take the following actions in MUR 6516:
1. Accept the signed conciliation agreement with Timothy Mobley, MTampa Financing, LLC, Express Freight of Florida, LLC, as recommended in the Memorandum from the Deputy General Counsel dated March 26, 2013.
2. Accept the signed conciliation agreement with Timothy Hohl, as recommended in the Memorandum from the Deputy General Counsel dated March 26, 2013.
3. Approve the appropriate letters.
4. Close the file.
The Commission decided by a vote of 5-0 to take the following actions in MUR 6516:
Accept the signed conciliation agreement with Terry Keith Howell, as
recommended in the Memorandum from the Deputy General Counsel ? Law dated
January 24, 2013.
Approve the appropriate letter.
Close the file as to Terry Keith Howell .
The Commission decided by a vote of 5-0 to take the following actions in MUR 6054:
Open a MUR.
Sever from MUR 6054 and place in the new MUR the following respondents in MUR 6054:
Timothy F. Mobley.
Timothy M. Hohl.
Express Freight of Florida, LLC.
MTampa Financing Company, LLC.
Terry Keith Howell.
Close the file in MUR 6054.
Approve the appropriate letters.
The Commission decided by a vote of 5 - 0 to: take the following actions with respect to General Counsel?s Report #3 in
MUR 6054:
1. Find reason to believe that Timothy F. Mobley violated 2 U.S.C. § 441f.
2. Find reason to believe that Timothy M. Hohl violated 2 U.S.C. § 441f.
3. Find reason to believe that Express Freight of Florida, LLC, violated 2 U.S.C. § 441f.
4. Find reason to believe that MTampa Financing Company, LLC, violated 2 U.S.C. §§ 441b(a) and 441f.
5. Approve the Factual and Legal Analyses, as recommended in General Counsel?s Report #3 dated March 9, 2010, subject to revisions to indicate there are possible knowing and willful violations at issue.
6. Find reason to believe that Terry Keith Howell violated 2 U.S.C. § 441f.
7. Direct the Office of General Counsel to prepare a Factual and Legal Analysis
for Terry Keith Howell consistent with the meeting discussion.
8. Approve the appropriate letters.
