DISPOSITION: The Commission failed by a vote of 3-3 to find reason to believe that Robert E. Andrews and Rob Andrews U.S. House Committee and Maureen Doherty, in her official capacity as treasurer, violated 2 U.S.C. § 439a(b)(1) and 11 C.F.R. § 113.1(g)(1) by using campaign funds to pay for non-campaign related expenses incurred by Andrew's daughter when she accompanied him on campaign trips to California.
The Commission failed by a vote of 3-3 to find reason to believe that Robert E. Andrews and Rob Andrews U.S. House Committee and Maureen Doherty, in her official capacity as treasurer, violated 2 U.S.C. § 439a(b)(1) and 11 C.F.R. § 113.1(g)(1) by using campaign funds to pay for non-campaign related travel to Scotland.
The Commission decided by a vote of 6-0 to find no reason to believe that Robert E. Andrews and Rob Andrews U.S. House Committee and Maureen Doherty, in her official capacity as treasurer, violated 2 U.S.C. § 439a(b)(1) and 11 C.F.R. § 113.1(g)(1) by using campaign funds to pay for expenses related to a June 2011 party at Andrew's home.
The Commission decided by a vote of 6-0 to approve the Factual and Legal Analysis as recommended in the First General Counsel's Report dated August 9, 2013 as edited by Vice Chair Ravel's Office on May 13, 2014 with respect to "B. June 2011 Party" which begins on page 12, line 10 and continues through page 14, line 3.
The Commission failed by a vote of 2-4 to find reason to believe that Robert E. Andrews and Rob Andrews U.S. House Committee and Maureen Doherty, in her official capacity as treasurer, violated 2 U.S.C. § 439a(b)(1) and 11 C.F.R. § 113.1(g)(1) by using campaign funds to make donations to local charitable organizations.
The Commission decided by a vote of 4-2 to: a. Dismiss the allegation that Robert E. Andrews and Rob Andrews U.S. House Committee and Maureen Doherty, in her official capacity as treasurer, violated 2 U.S.C. § 439a(b)(1) and 11 C.F.R. § 113.1(g)(1) by using campaign funds to pay for non-campaign related expenses incurred by Andrew's daughter when she accompanied him on campaign trips to California. b. Exercise its prosecutorial discretion and dismiss the allegation that Robert E. Andrews and Rob Andrews U.S. House Committee and Maureen Doherty, in her official capacity as treasurer, violated 2 U.S.C. § 439a(b)(1) and 11 C.F.R. § 113.1(g)(1) by using campaign funds to pay for non-campaign related travel to Scotland. c. Find no reason to believe that Robert E. Andrews and Rob Andrews U.S. House Committee and Maureen Doherty, in her official capacity as treasurer, violated 2 U.S.C. § 439a(b)(1) and 11 C.F.R. § 113.1(g)(1) by using campaign funds to make donations to local charitable organizations. d . Approve the proposed Factual and Legal Analysis as recommended in the First General Counsel's Report dated August 9, 2013, most recently circulated by Vice Chair Ravel's Office on May 13, 2014. e. Send the appropriate letters. f. Close the file. g. Authorize the Office of General Counsel to make technical and conforming edits and amendments as necessary.
