DISPOSITION: to take the following actions in MUR 6449:
Accept the conciliation agreement with Jon Bruning and Bruning for Senate, Inc.
f/k/a Bruning 2012 Exploratory Committee and Douglas R. Ayer in his official
capacity as treasurer, as recommended in the General Counsel?s Memorandum dated
March 29, 2013.
Approve the appropriate letter.
Close the file.
to take the following actions:
1. Find reason to believe that Jon Bruning violated 2 U.S.C. § 432(e)(1) and
11 C.F.R. § 101.1(a).
2. Find reason to believe that Bruning for Senate, Inc. f/k/a Bruning 2012
Exploratory Committee and Douglas R. Ayer in his official capacity as
treasurer violated 2 U.S.C. §§ 433(a), 434(a) and 434(b).
3. Dismiss the allegation that Jon Bruning Exploratory Committee violated
2 U.S.C. §§ 433(a) and 434(a).
4. Find no reason to believe that Bruning for Senate, Inc. f/k/a Bruning 2012
Exploratory Committee and Douglas R. Ayer in his official capacity as
treasurer violated 2 U.S.C. § 441a(f).
5. Find no reason to believe that Friends of Jon Bruning and Douglas R. Ayer
in
his official capacity as treasurer (terminated) violated the Act.
6. Enter into conciliation with Jon Bruning and Bruning for Senate, Inc. f/k/a
Bruning 2012 Exploratory Committee and Douglas R. Ayer in his official capacity
as treasurer prior to a finding of probable cause to believe.
7. Approve the conciliation agreement as recommended in the First General
Counsel?s Report dated August 9, 2012 subject to the edits previously
circulated.
8. Approve the Factual and Legal Analysis as recommended in the First General
Counsel?s Report dated August 9, 2012 subject to the edits previously
circulated and with technical and conforming changes.
9. Approve the appropriate letters.
