DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 6440: 1. Accept the signed conciliation agreement with Frank Guinta and Friends of Frank Guinta and Paul Kilgore in his official capacity as treasurer, as recommended in the Memorandum from the Associate General Counsel for Enforcement dated April 21, 2015. 2. Approve the appropriate letters. 3. Close the file.
The Commission failed by a vote of 3-3 to: a. Enter into conciliation, prior to findings of probable cause to believe, with Frank Guinta, and Friends of Frank Guinta and Bradley T. Crate in his official capacity as treasurer. b. Take no action as to Richard Guinta and Magdalene Virginia Guinta other than send a caution letter with respect to violations of 52 U.S.C. §§ 30116 and 30122 (formerly 2 U.S.C. §§ 441a and 441f), and close the file as to them. c......................................REDACTED..................................... d. The Commission decided on a vote of 6-0 to take the following actions in MUR 6363 and MUR 6440: 1. Merge MUR 6363 into MUR 6440. 2. Find reason to believe that Friends of Frank Guinta and Louis DeMato, in his official capacity as Treasurer, violated 2 U.S.C. §§ 434(b) and 441a(f). 3. Find reason to believe that Frank Guinta violated 2 U.S.C. § 441f. 4. Authorize the use of compulsory process, including interrogatories and subpoenas, as necessary. 5. Approve the Factual and Legal Analysis as recommended in the General Counsel's Report dated May 9, 2011, with the modification to page 6, line 21 to add the phrase "in the news media" after the word "representations." 6. Approve the appropriate letters.
