DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 6394: 1. Accept the joint conciliation agreement with Rochelle M. Pingree, Pingree for Congress and Anne Rand in her official capacity as treasurer, and S. Donald Sussman, as recommended in the Memorandum from the Associate General Counsel for Enforcement dated June 25, 2015. 2. Approve the appropriate letters. 3. Close the file.

The Commission decided by a vote of 6-0 to: Find probable cause to believe that Rochelle M. Pingree violated 52 U.S.C. §§ 30114(c)(2), 30116(f), and 11 C.F.R. § 100.93(c)(2) and 113.5(b), that Pingree for Congress and Anne Rand in her official capacity as treasurer violated 52 U.S.C. §§ 30114(c)(2), 30116(f), and 11 C.F.R. § 113.5(b), and that S. Donald Sussman violated 52 U.S.C. § 30116(a)(1)(A).
The Commission decided by a vote of 4-0 to: 1. Enter into pre-probable cause conciliation with Rochelle M. Pingree. 2. Enter into pre-probable cause conciliation with Pingree for Congress and Anne Rand in her official capacity as treasurer. 3. Enter into pre-probable cause conciliation with S. Donald Sussman. 4. Approve the joint conciliation agreement, as recommended in the Second General Counsel's Report dated June 12, 2013. 5. Take no further action regarding the Commission's reason to believe finding that Magic Carpet Enterprises, LLC violated 2 U.S.C. § 441b(a) and that S. Donald Sussman violated 2 U.S.C. § 441b(a) and 11 C.F.R. § 114.2(e). 6. Take no further action regarding the Commission's reason to believe finding that Pingree for Congress and Anne Rand in her official capacity as treasurer violated 2 U.S.C. § 441b(a). 7. Approve the appropriate letters.
The Commission passed on a vote of 5-0 to take the following actions in MUR 6394: 1. Find reason to believe that Rochelle M. Pingree violated 2 U.S.C. § 439a(c)(2) and 11 C.F.R. §§ 100.93(c)(2) and 113.5(b). 2. Find reason to believe that Rochelle M. Pingree violated 2 U.S.C. § 441b(a) or, alternatively 2 U.S.C. § 441a(f). 3. Find reason to believe that Pingree for Congress and Anne Rand, in her official capacity as treasurer, violated 2 U.S.C. § 439a(c)(2) and 11 C.F.R. 113.5(b). 4. Find reason to believe that Pingree for Congress and Anne Rand, in her official capacity as treasurer, violated 2 U.S.C. § 441b(a) or, alternatively, 2 U.S.C. §441a(f). 5. Find reason to believe that Magic Carpet Enterprises LLC violated 2 U.S.C. § 441b(a) and that S. Donald Sussman violated 2 U.S.C. § 441b(a) and 11 C.F.R. § 114.2(e) or, alternatively, 6. Find reason to believe that S. Donald Sussman violated 2 U.S.C. § 441a(a)(1)(A). 7. Approve the Factual and Legal Analyses as recommended in the First General Counsel's Report dated April 18, 2011. 8. Authorize the use of compulsory process. 9. Approve the appropriate letters.
