DISPOSITION: The Commission decided by a vote of 5-0 to take the following actions in MUR 6317:1. Accept the conciliation agreement with Utah Defenders of Constitutional Integrity, as recommended in the General Counsel's Memoranda dated February 16, 2012 and February 21, 2012.2. Take no action as to Timothy Stewart, in his individual capacity.3. Approve the appropriate letters.4. Close the file.
The Commission decided by a vote of 5-0 to take the following actions in MUR 6317:1. Find reason to believe that Utah Defenders of Constitutional Integrity violated 2 U.S.C. § 433 by failing to register as a political committee.2. Find reason to believe that Utah Defenders of Constitutional Integrity violated 2 U.S.C. § 434 by failing to file disclosure reports.3. Find reason to believe that Utah Defenders of Constitutional Integrity violated 2 U.S.C. § 441d by failing to provide the appropriate disclaimer.4. Find no reason to believe that SADDLEPAC and Timothy Stewart, in his official capacity as Treasurer, violated 2 U.S.C. §§ 433, 434, and 441d.5. Take no action at this time with regard to Timothy Stewart in his personal capacity or as a possible officer of Utah Defenders of Constitutional Integrity. 6. Authorize the use of compulsory process as to the Respondents and all witnesses in this matter, including the issuance of appropriate interrogatories, document subpoenas, and deposition subpoenas, as necessary, which will be circulated on a tally vote basis at the appropriate time.7. Approve the Factual and Legal Analyses as follows: a. With respect to Utah Defenders of Constitutional Integrity, approve the Factual and Legal Analysis as recommended in the First General Counsel's Report dated December 6, 2010 subject to previously circulated edits by the Office of the Chair on March 30, 2011. b. With respect to SADDLEPAC and Timothy Stewart, in his official capacity as Treasurer, approve the Factual and Legal Analysis as recommended in the First General Counsel's Report dated December 6, 2010. 8. Approve the appropriate letters.
