DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 6188:1. Accept the signed conciliation agreement, as recommended in the General Counsel's Memorandum dated February 14, 2011.2. Approve the appropriate letter.3. Close the file.
The Commission failed by a vote of 3-3- to: 1) Open a MUR. 2) Find reason to believe that the San Antonio Police Officers' Association PAC and Robert Grajeda, in his official capacity as treasurer, violated 2 U.S.C §§432(c)(5), 434(b)(4) and (6). 3) Find reason to believe that Clifford Morgan knowingly and willfully violated 2 U.S.C. §§432(b)(3), 432(c)(5), 434(b)(4) and (6).4) Enter into conciliation with the San Antonio Police Officers' Association PAC and Robert Grajeda, in his official capacity as treasurer, prior to a finding of probable cause to believe. 5) Enter into conciliation with Clifford Morgan prior to a finding of probable cause to believe. 6) Approve the Factual and Legal Analysis for the San Antonio Police Officers' Asssociation PAC, as recommended in the First General Counsel's Report dated April 10, 2009. 7) Approve the Factual and Legal Analysis for Clifford Morgan, as recommended in the First General Counsel's Report dated April 10, 2009.8) Approve the conciliation agreement with the San Antonio Police Officers' Association PAC, as recommended in the First General Counsel's Report dated April 10, 2009.9) Approve the conciliation agreement with Clifford Morgan, as recommended in the First General Counsel's Report dated April 10, 2009.10) Approve the appropriate letters.
The Commission decided by a vote of 6-0 to:1) Refer the matter which pertains to the San Antonio Police Officers' Association PAC and Robert Grajeda, in his official capacity as treasurer, to the Office of Alternative Dispute Resolution. 2) Open a MUR. 3) Find reason to believe that Clifford Morgan knowingly and willfully violated 2 U.S.C. §§432(c) (5), 434(b)(4) and (6). 4) Enter into conciliation with Clifford Morgan prior to a finding of probable cause to believe.5) Approve the Factual and Legal Analysis for Clifford Morgan, as recommended in the First General Counsel's Report dated April 10, 2009, as amended.6) Approve the conciliation agreement with Clifford Morgan, as recommended in the First General Counsel's Report dated April 10, 2009, as amended.7) Approve the appropriate letters.
