DISPOSITION: The Commission decided by a vote of 6-0 on an amended pre-meeting tally, to take the following actions in MUR 6138:1. Take no further action regarding the reason to believe finding that Honeycutt for Congress and Scott Mackenzie, in his official capacity as treasurer, and Andrew Honeycutt knowingly and willfully violated 2 U.S.C. § 441d(a).2. Take no further action regarding the reason to believe finding that Honeycutt for Congress and Scott Mackenzie, in his official capacity as treasurer, violated 2 U.S.C. § 434(b) and caution these respondents.3. Take no further action regarding the reason to believe finding that Democrats for Good Government and David Knox violated 2 U.S.C. § 441d(a).4. Take no further action regarding the reason to believe finding that Democrats for Good Government and David Knox violated 2 U.S.C. § 434(c).5. Dismiss the allegation that Democrats for Good Government violated 2 U.S.C. §§ 433 and 434 by failing to register and report as a political committee and caution this respondent.6. Approve the Factual and Legal Analysis for Democrats for Good Government as recommended in General Counsel's Report # 2 dated July 27, 2011 with edits as previously circulated. 7. Approve the appropriate letters, including letters cautioning Honeycutt for Congress and Scott Mackenzie, in his official capacity as treasurer, and Democrats for Good Government.8. Close the file as to all respondents.
The Commission decided by a vote of 6-0 to::a) Find reason to believe that Honeycutt for Congress and Scott Mackenzie, in his official capacity as treasurer, knowingly and willfully violated 2 U.S.C. § 441d(a).b) Find reason to believe that Andrew Honeycutt knowingly and willfully violated 2 U.S.C. § 441d(a).c) Find reason to believe that Democrats for Good Government and David Knox violated 2 U.S.C. § 441d(a).d) Find reason to believe that Honeycutt for Congress and Scott Mackenzie, in his official capacity as treasurer, violated 2 U.S.C. § 434(b).e) Find reason to believe that Democrats for Good Government and David Knox violated 2 U.S.C. § 434(c).f) Approve the Factual and Legal Analyses, as recommended in the First General Counsel's Report dated February 26, 2010, subject to the revisions previously circulated and pursuant to the meeting discussion.g) Authorize the use of compulsory process as to all respondents and witnesses in this matter, including the issuance of appropriate interrogatories, document subpoenas, and deposition subpoenas, as necessary.h) Approve the appropriate letters.
The Commission failed by a vote of 3-3 to Find no reason to believe that Andrew Honeycutt, Honeycutt for Congress and Scott Mackenzie, in his official capacity as treasurer, Democrats for Good Government, or David Knox violated 2 U.S.C. § 441h(a).
