DISPOSITION: The Commission decided by a vote of 4 - 0 to close the file in MUR 6082 and send the appropriate letters.
The Commission failed by a vote of 2-2 to pass a motion to take the following actions in MUR 6082:1. Find reason to believe that Majority Action violated 2 U.S.C. §§ 433, 434, 441a(f), and 441b(a).2.Approve the Factual and Legal Analysis, as recommended in the First General Counsel's Report dated March 2, 2009.3. Authorize the use of compulsory process with respect to respondent and all witnesses, including the issuance of appropriate interrogatories, document subpoenas, and deposition subpoenas, as necessary.4. Approve the appropriate letters. 5.Merge MUR 5842 (Majority Action) with MUR 6082.
The Commission failed by a vote of 2-2 to pass a motion to take the following actions in MUR 6082:1.Find reason to believe that Majority Action violated 2 U.S.C. §§ 433, 434, 441a(f), and 441b(a) by failing to register as a political committee with the Commission, by failing to report contributions and expenditures, by knowingly accepting contributions in excess of $5,000, and by knowingly accepting union contributions.2. Take no action at this time as to Mark Longabaugh.3. Approve the Factual and Legal Analysis, as recommended in General Counsel's Report #2 dated March 10, 2009.4.Authorize the use of compulsory process with respect to all respondents and witnesses, including the issuance of appropriate interrogatories, document subpoenas, and deposition subpoenas, as necessary.5.Approve the appropriate letters.
