DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 6040:1. Accept the conciliation agreement with Fourth Lenox Terrace Associates a/k/a Lenox Terrace Development Associates, as recommended in the General Counsel's Memorandum dated March 7, 2012, subject to the edits circulated via email by the Office of General Counsel.2. Accept the conciliation agreement with Representative Charles B. Rangel, Rangel for Congress and Basil Paterson, in his official capacity as treasurer, and the National Leadership PAC and Basil Paterson in his official capacity as treasurer, as recommended in the General Counsel's Memorandum dated March 7, 2012.3. Approve the appropriate letters.4. Close the file.
The Commission decided by a vote of 6-0 on an amended pre-meeting tally, to take the following actions in MUR 6040: 1. Find reason to believe that Representative Charles B. Rangel violated 2 U.S.C. § 441a(f).2. Enter into conciliation with Representative Charles B. Rangel prior to a finding of probable cause to believe.3. Approve the Factual and Legal Analysis as recommended in the Memorandum to the Commission dated October 14, 2011.4. Approve the Conciliation Agreement for Representative Charles B. Rangel; Rangel for Congress and Basil Paterson, in his official capacity as treasurer; and the National Leadership PAC and Basil Paterson, in his official capacity as treasurer, as recommended in the Memorandum to the Commission dated October 14, 2011.5. Approve the appropriate letter.
The Commission decided by a vote of 5-0 to take the following actions in MUR 6040:1. Find no reason to believe that the Olnick Organization, Inc. violated 2 U.S.C. § 441b, and close the file as to it.2. Enter into conciliation with Fourth Lenox Terrace Associates a/k/a Lenox Terrace Development Assoc., prior to a finding of probable cause to believe.3. Enter into conciliation with Rangel for Congress and Basil Paterson, in his official capacity as treasurer; and the National Leadership PAC and Basil Paterson, in his official capacity as treasurer, prior to a finding of probable cause to believe.4. Approve the Factual and Legal Analysis for the Olnick Organization, Inc. as recommended in General Counsel's Report #2 dated August 9, 2011. 5. Approve the proposed conciliation agreement for Fourth Lenox Terrace Associates a/k/a Lenox Terrace Development Assoc. as recommended in General Counsel's Report #2 dated August 9, 2011, with an amended civil money penalty pursuant to the meeting discussion.6. Approve the appropriate letters.
The Commission decided by a vote of 5-0 to take the following actions in MUR 6040:1. Find reason to believe that Fourth Lenox Terrace Associates a/k/a Lenox Terrace Development Assoc. violated 2 U.S.C. § 441a(a)(1)(A) and (C).2. Find reason to believe that Rangel for Congress and Basil Paterson, in his official capacity as treasurer, violated 2 U.S.C. §§ 434(b) and 441a(f).3. Find reason to believe that the National Leadership PAC and Basil Paterson, in his official capacity as treasurer, violated 2 U.S.C. §§ 434(b) and 441a(f).4. Take no action at this time with respect to the Olnick Organization, Inc.5. Take no action at this time with respect to Representative Charles B. Rangel.6. Authorize the Factual and Legal Analyses, as recommended in the First General Counsel's Report dated November 30, 2009, subject to revisions to the Factual and Legal Analysis at Attachment 1 (Fourth Lenox Terrace Associates) as previously circulated via electronic mail and pursuant to the meeting discussion, with corresponding revisions to the Factual and Legal Analysis at Attachment 2 (Rangel for Congress, et al.).7. Authorize the use of compulsory process.8. Approve the appropriate letters.
