DISPOSITION: The Commission decided by a vote of 6 - 0 on an amended pre-meeting tally, to take the following actions in MUR 5871: 1. Accept the conciliation agreements as to Joseph Restivo, Howard D. Talbott, Donna Owens, Sally Perz, Betty Shultz, Sam Thurber and Margaret Thurber, as recommended in General Counsel's Report #4 dated May 2, 2008. 2Take no further action except send a letter of admonishment to Phillip Swy, Allison Perz, Barton Kulish, Michael P. Boyle, James J. Mermis, Joseph Moormann, Susan Talbott, William McElheney, Joe Perz, Jeffrey Mann, Corrine A. Mann, Kimberly Mermis and Connie Moormann. 3.Send a letter of admonishment to Hope Sattler, Dwayne Sattler, Susan Metzger and Joseph Kidd. 4. Approve the appropriate letters. 5. Close the file.
The Commission decided by a vote of 5-0 to take the following actions in MUR 5871:
1. Enter into conciliation prior to findings of probable cause to believe with respondents Joseph Restivo, Howard D. Talbott, Sally Perz, Margaret Thurber, Sam Thurber, Betty Shultz, and Donna Owens.
2. Take no further action with respect to Thomas W. Noe.
3. Approve the conciliation agreements, as recommended in the General Counsel?s Report dated November 28, 2007, subject to the following revisions:
(a) Revise the civil penalty amount for Joseph Restivo by increasing the
calculation percentage to 500% of the amount in violation.
(b) Revise the civil penalty amount for Howard D. Talbott by increasing the
calculation percentage to 450% of the amount in violation.
4. Approve the Factual and Legal Analysis, as recommended in the General Counsel?s Report dated November 28, 2007.
5. Approve the appropriate letters.
The Commission decided by a vote of 5-0 to take the following actions in MUR 5871: 1. Substitute the names of respondents Howard D. Talbott, Joseph Restivo, Sally Perz, Margaret L. Thurber, Sam Thurber, Betty Shultz, Donna Owens, Phillip Swy, Allison Perz, Jeffrey Mann, Barton Kulish, Michael P. Boyle, James J. Mermis, Joseph Moormann, Susan Talbott, William McElheney, Joe Perz, Corrine A. Mann, Kimberly Mermis and Connie Moorman in place of "unknown respondents" in the Commission's previous finding that there is reason to believe unknown respondents knowingly and willfully violated 2 U.S.C. § 441f. 2. Take no action at this time with respect to Hope Sattler, Dwayne Sattler, Susan Metzger, and Joseph Kidd. 3. Approve the appropriate letters.
The Commission decided by a vote of 6-0 to take the following actions in Pre-MUR 437: 1. Open a matter under review. 2. Find reason to believe that Thomas W. Noe knowingly and willfully violated 2 U.S.C. §§ 441f, 441a(a)(1)(A) and 441a(a)(3)(A). 3. Find reason to believe unknown respondents knowingly and willfully violated 2 U.S.C. § 441f. 4. Approve the Factual and Legal Analysis with respect to Thomas W. Noe, as recommended in the First General Counsel?s Report dated October 24, 2006. 5. Approve the sample Factual and Legal Analysis with respect to unknown respondents, as recommended in the First General Counsel's Report dated October 24, 2006. 6. Authorize the use of compulsory process, including the issuance of appropriate interrogatories, document subpoenas, and deposition subpoenas, as necessary. 7. Approve the appropriate letters.
