DISPOSITION: The Commission decided by a vote of 5-0 to take the following actions in MUR 5850:1. Take no further action other than to admonish the Republican National Committee and Timothy J. Morgan, in his official capacity as Treasurer, for violating 11 C.F.R. § 104.14(b) by failing to maintain records to verify the dates of certain independent expenditures and 2 U.S.C. § 434(g)(1)(A) and 11 C.F.R. § 104.4(c) by failing to file two 24-Hour Notices.2. Approve the Factual and Legal Analysis, as recommended in the General Counsel's Report #2 dated November 29, 2007.3. Close the file.4. Approve the appropriate letter.
The Commission decided by a vote of 6-0 to take the following actions in RAD Referral 05L-65:1) Open a MUR in RAD Referral 05L-65.2) Find reason to believe that the Republican National Committee and Bob Kjellander, in his official capacity as Treasurer, violated 2 U.S.C. § 434(g)(1)(A) and 11 CFR § 104.4(c) by failing to file seven 24 Hour Notices relating to thirteen independent expenditures.3) Find reason to believe that the Republican National Committee and Bob Kjellander, in his official capacity as Treasurer, violated 2 U.S.C. § 434(b)(4)(H)(iii) and 11 CFR § 104.4(a) by failing to report certain independent expenditures on Schedule E of its 2004 Post-General Report.4).....................REDACTED...............................5) Approve the Factual and Legal Analysis, as recommended in the General Counsel's Report dated September 21, 2006. 6) Approve the appropriate letter.
