DISPOSITION: The Commission decided by a vote of 6 - 0 to take the following actions in MUR 5814:1. As a matter of prosecutorial discretion, take no further action as to Lamutt for Congress and Robert Bruce Lamutt, in his official capacity as treasurer, in connection with the reason to believe findings that the Respondents' violated 2 U.S.C. §§ 432(c)(5), 434(b)(4)(G) & (6)(A) and 11 C.F.R. § 104.3(b).2. Approve the Factual and Legal Analysis, as recommended in the General Counsel's Report #4 dated May 6, 2009.3. Approve the appropriate cautionary letter.4. Close the file.

The Commission decided by a vote of 4-0 to take the following actions in RAD Referral 05L-27:1. Open a MUR.2. Find reason to believe that Jack Thomas knowingly and willfully violated 2 U.S.C. §§ 432(b)(3) and 439a(b).3. Find reason to believe that Lamutt for Congress and Robert Bruce Lamutt, in his official capacity as treasurer, violated 2 U.S.C. §§ 432(c)(5), 434(b)(4)(G) & (6)(A), 441a-1(b)(1)(D) and 11 CFR §§ 104.3(b) and 400.22(b).4. Find reason to believe that Robert Bruce Lamutt violated 2 U.S.C. §441a-1(b)(1)(D) and 11 CFR § 440.25.5. ...... REDACTED ........ 6.
